Der Nationalrat hat beschlossen:
Der Abschluss des nachstehenden Staatsvertrages samt Anlage, dessen Artikel XXI Absatz 4 zweiter Satz verfassungsändernd ist, wird genehmigt.

DECLARATION
The Federal
President of the Republic of Austria hereby declares the acceptance of the New
Revised Text of the International Plant Protection Convention, approved by FAO
at the twentyninth meeting of its Conference in November 1997 and, in the name
of the Republic of Austria, undertakes to abide by the said revised text of the
Convention. The Optional Clauses contained in the Model Phytosanitary
Certificate shall be used by the Republic of Austria to the effect that no
financial liability towards any other Contracting Party shall be undertaken
with respect to the issuance of these certificates and that the certification
of plants, plant products or other regulated articles to be deemed practically
free from other pests shall not be used.

ANNAHMEERKLÄRUNG
Der Bundespräsident der Republik Österreich erklärt die Annahme des von der Konferenz der FAO anläßlich ihrer 29. Tagung im November 1997 approbierten revidierten Textes der Internationalen Pflanzenschutzkonvention und verspricht namens der Republik Österreich die getreuliche Befolgung der Konvention. Von den in den Mustern der Pflanzengesundheitszeugnisse enthaltenen ,,Freiwilligen Klauseln“ macht die Republik Österreich in dem Sinne Gebrauch, dass sie hinsichtlich der Ausstellung dieser Zeugnisse keine finanzielle Haftung gegenüber einer anderen vertragschließenden Partei übernimmt und dass die Bestätigung, wonach die beschriebenen Pflanzen, Pflanzenerzeugnisse und anderen geregelten Gegenstände als praktisch frei von anderen Schadorganismen betrachtet werden, nicht zur Anwendung gelangt.

REVISED TEXT OF THE INTERNATIONAL
PLANT PROTECTION CONVENTION
PREAMBLE
The contracting
parties,
recognizing the necessity for international
cooperation in controlling pests of plants and plant products and in preventing
their international spread, and especially their introduction into endangered
areas;
recognizing that phytosanitary measures should
be technically justified, transparent and should not be applied in such a way
as to constitute either a means of arbitrara or unjustifed discrimination or a
disguised restriction, particularly on international trade;
desiring to ensure close coordination of
measures directed to these ends;
desiring to provide a framework for the
development and application of harmonized phytosanitary measures and the
elaboration of international standards to that effect;
taking into account internationally approved principles governing the protection of plant,
human and animal health, and the environment; and
noting the agreements concluded as a
result of the Uruguay Round of Multilateral Trade Negotiations, including the
Agreement on the Application of Sanitary and Phytosanitary Measures;
have agreed as
follows:
Article I
Purpose
and responsibility
1. With the
purpose of securing common and effective action to prevent the spread and
introduction of pests of plants and plant products, and to promote appropriate
measures for their control, the contracting parties undertake to adopt the
legislative, technical and administrative measures specified in this Convention
and in supplementary agreements pursuant to Article XVI.
2. Each contracting party shall assume responsibility, without prejudice
to obligations assumed under other international agreements, for the fulfilment
within its territories of all requirements under this Convention.
3. The division of responsibilities for the fulfilment of the
requirements of this Convention between member organizations of FAO and their
member states that are contracting parties shall be in accordance with their
respective competencies.
4. Where appropriate, the provisions of this Convention may be deemed by
contracting parties to extend, in addition to plants and plant products, to
storage places, packaging, conveyances, containers, soil and any other
organism, object or material capable of harbouring or spreading plant pests,
particularly where international transportation is involved.
Article II
Use of
terms
1. For the
purpose of this Convention, the following terms shall have the meanings
hereunder assigned to them:
– “Area of low pest prevalence” – an area,
whether all of a country, part of a country, or all or parts of several
countries, as identified by the competent authorities, in which a specific pest
occurs at low levels and which is subject to effective surveillance, control or
eradication measures;
– “Commission” – the Commission on
Phytosanitary Measures established under Article XI;
– “Endangered area” – an area where
ecological factors favour the establishment of a pest whose presence in the
area will result in economically important loss;
– “Establishment” – perpetuation, for
the foreseeable future, of a pest within an area after entry;
– “Harmonized phytosanitary measures” –
phytosanitary measures established by contracting parties based on
international standards;
– “International standards” –
international standards established in accordance with Article X,
paragraphs 1 and 2;
– “Introduction” – the entry of a pest
resulting in its establishment;
– “Pest” – any species, strain or
biotype of plant, animal or pathogenic agent injurious to plants or plant
products;
– “Pest risk analysis” – the process of
evaluating biological or other scientific and economic evidence to determine
whether a pest should be regulated and the strength of any phytosanitary
measures to be taken against it;
– “Phytosanitary measure” – any
legislation, regulation or official procedure having the purpose to prevent the
introduction and/or spread of pests;
– “Plant products” – unmanufactured
material of plant origin (including grain) and those manufactured products
that, by their nature or that of their processing, may create a risk for the
introduction and spread of pests;
– “Plants” – living plants and parts
thereof, including seeds and germplasm;
– “Quarantine pest” – a pest of
potential economic importance to the area endangered thereby and not yet
present there, or present but not widely distributed and being officially
controlled;
– “Regional standards” – standards established
by a regional plant protection organization for the guidance of the members of
that organization;
– “Regulated article” – any plant,
plant product, storage place, packaging, conveyance, container, soil and any
other organism, object or material capable of harbouring or spreading pests,
deemed to require phytosanitary measures, particularly where international
transportation is involved;
– “Regulated non-quarantine pest” – a
non-quarantine pest whose presence in plants for planting affects the intended
use of those plants with an economically unacceptable impact and which is
therefore regulated within the territory of the importing contracting party;
– “Regulated pest” – a quarantine pest
or a regulated non-quarantine pest;
– “Secretary” – Secretary of the
Commission appointed pursuant to Article XII;
– “Technically justified” – justified
on the basis of conclusions reached by using an appropriate pest risk analysis
or, where applicable, another comparable examination and evaluation of available
scientific information.
2. The
definitions set forth in this Article, being limited to the application of this
Convention, shall not be deemed to affect definitions established under
domestic laws or regulations of contracting parties.
Article III
Relationship
with other international agreements
Nothing in this
Convention shall affect the rights and obligations of the contracting parties
under relevant international agreements.
Article IV
General
provisions relating to the organizational arrangements for national plant
protection
1. Each
contracting party shall make provision, to the best of its ability, for an
official national plant protection organization with the main responsibilities
set out in this Article.
2. The
responsibilities of an official national plant protection organization shall
include the following:
a) the issuance of certificates relating to the
phytosanitary regulations of the importing contracting party for consignments
of plants, plant products and other regulated articles;
b) the surveillance of growing plants, including
both areas under cultivation (inter
alia fields,
plantations, nurseries, gardens, greenhouses and laboratories) and wild flora,
and of plants and plant products in storage or in transportation, particularly
with the object of reporting the occurrence, outbreak and spread of pests, and
of controlling those pests, including the reporting referred to under
Article VIII paragraph 1(a);
c) the inspection of consignments of plants and
plant products moving in international traffic and, where appropriate, the
inspection of other regulated articles, particularly with the object of
preventing the introduction and/or spread of pests;
d) the disinfestation or disinfection of
consignments of plants, plant products and other regulated articles moving in
international traffic, to meet phytosanitary requirements;
e) the protection of endangered areas and the
designation, maintenance and surveillance of pest free areas and areas of low
pest prevalence;
f) the conduct of pest risk analyses;
g) to ensure through appropriate procedures that
the phytosanitary security of consignments after certification regarding
composition, substitution and reinfestation is maintained prior to export; and
h) training and development of staff.
3. Each contracting party shall make provision, to the best of its
ability, for the following:
a) the distribution of information within the
territory of the contracting party regarding regulated pests and the means of
their prevention and control;
b) research and investigation in the field of
plant protection;
c) the issuance of phytosanitary regulations; and
d) the performance of such other functions as may
be required for the implementation of this Convention.
4. Each contracting party shall submit a description of its official
national plant protection organization and of changes in such organization to
the Secretary. A contracting party shall provide a description of its
organizational arrangements for plant protection to another contracting party, upon
request.
Article V
Phytosanitary certification
1. Each contracting party shall make arrangements for phytosanitary
certification, with the objective of ensuring that exported plants, plant
products and other regulated articles and consignments thereof are in
conformity with the certifying statement to be made pursuant to paragraph 2(b)
of this Article.
2. Each
contracting party shall make arrangements for the issuance of phytosanitary
certificates in conformity with the following provisions:
a) Inspection and other related activities leading
to issuance of phytosanitary certificates shall be carried out only by or under
the authority of the official national plant protection organization. The
issuance of phytosanitary certificates shall be carried out by public officers
who are technically qualified and duly authorized by the official national
plant protection organization to act on its behalf and under its control with
such knowledge and information available to those officers that the authorities
of importing contracting parties may accept the phytosanitary certificates with
confidence as dependable documents.
b) Phytosanitary certificates, or their electronic
equivalent where accepted by the importing contracting party concerned, shall
be as worded in the models set out in the Annex to this Convention. These
certificates should be completed and issued taking into account relevant
international standards.
c) Uncertified alterations or erasures shall
invalidate the certificates.
3. Each contracting party undertakes not to require consignments of
plants or plant products or other regulated articles imported into its
territories to be accompanied by phytosanitary certificates inconsistent with
the models set out in the Annex to this Convention. Any requirements for
additional declarations shall be limited to those technically justified.
Article VI
Regulated pests
1. Contracting parties may require phytosanitary measures for quarantine
pests and regulated non-quarantine pests, provided that such measures are:
a) no more stringent than measures applied to the
same pests, if present within the territory of the importing contracting party;
and
b) limited to what is necessary to protect plant
health and/or safeguard the intended use and can be technically justified by
the contracting party concerned.
2. Contracting parties shall not require phytosanitary measures for
non-regulated pests.
Article VII
Requirements in relation to imports
1. With the aim of preventing the introduction and/or spread of
regulated pests into their territories, contracting parties shall have
sovereign authority to regulate, in accordance with applicable international
agreements, the entry of plants and plant products and other regulated articles
and, to this end, may:
a) prescribe and adopt phytosanitary measures
concerning the importation of plants, plant products and other regulated
articles, including, for example, inspection, prohibition on importation, and
treatment;
b) refuse entry or detain, or require treatment,
destruction or removal from the territory of the contracting party, of plants,
plant products and other regulated articles or consignments thereof that do not
comply with the phytosanitary measures prescribed or adopted under subparagraph
(a);
c) prohibit or restrict the movement of regulated
pests into their territories;
d) prohibit or restrict the movement of biological
control agents and other organisms of phytosanitary concern claimed to be
beneficial into their territories.
2. In order to minimize interference with international trade, each
contracting party, in exercising its authority under paragraph 1 of this
Article, undertakes to act in conformity with the following:
a) Contracting parties shall not, under their
phytosanitary legislation, take any of the measures specified in paragraph 1 of
this Article unless such measures are made necessary by phytosanitary
considerations and are technically justified.
b) Contracting parties shall, immediately upon
their adoption, publish and transmit phytosanitary requirements, restrictions
and prohibitions to any contracting party or parties that they believe may be
directly affected by such measures.
c) Contracting parties shall, on request, make
available to any contracting party the rationale for phytosanitary
requirements, restrictions and prohibitions.
d) If a contracting party requires consignments of
particular plants or plant products to be imported only through specified
points of entry, such points shall be so selected as not to unnecessarily
impede international trade. The contracting party shall publish a list of such
points of entry and communicate it to the Secretary, any regional plant
protection organization of which the contracting party is a member, all
contracting parties which the contracting party believes to be directly
affected, and other contracting parties upon request. Such restrictions on
points of entry shall not be made unless the plants, plant products or other
regulated articles concerned are required to be accompanied by phytosanitary
certificates or to be submitted to inspection or treatment.
e) Any inspection or other phytosanitary procedure
required by the plant protection organization of a contracting party for a
consignment of plants, plant products or other regulated articles offered for
importation, shall take place as promptly as possible with due regard to their
perishability.
f) Importing contracting parties shall, as soon as
possible, inform the exporting contracting party concerned or, where
appropriate, the re-exporting contracting party concerned, of significant
instances of non-compliance with phytosanitary certification. The exporting
contracting party or, where appropriate, the re-exporting contracting party
concerned, should investigate and, on request, report the result of its
investigation to the importing contracting party concerned.
g) Contracting parties shall institute only
phytosanitary measures that are technically justified, consistent with the pest
risk involved and represent the least restrictive measures available, and
result in the minimum impediment to the international movement of people,
commodities and conveyances.
h) Contracting parties shall, as conditions
change, and as new facts become available, ensure that phytosanitary measures
are promptly modified or removed if found to be unnecessary.
i) Contracting parties shall, to the best of their
ability, establish and update lists of regulated pests, using scientific names,
and make such lists available to the Secretary, to regional plant protection
organizations of which they are members and, on request, to other contracting
parties.
j) Contracting parties shall, to the best of their
ability, conduct surveillance for pests and develop and maintain adequate
information on pest status in order to support categorization of pests, and for
the development of appropriate phytosanitary measures. This information shall
be made available to contracting parties, on request.
3. A contracting party may apply measures specified in this
Article to pests which may not be capable of establishment in its
territories but, if they gained entry, cause economic damage. Measures taken
against these pests must be technically justified.
4. Contracting parties may apply measures specified in this
Article to consignments in transit through their territories only where
such measures are technically justified and necessary to prevent the
introduction and/or spread of pests.
5. Nothing in this Article shall prevent importing contracting
parties from making special provision, subject to adequate safeguards, for the
importation, for the purpose of scientific research, education, or other
specific use, of plants and plant products and other regulated articles, and of
plant pests.
6. Nothing in
this Article shall prevent any contracting party from taking appropriate
emergency action on the detection of a pest posing a potential threat to its
territories or the report of such a detection. Any such action shall be
evaluated as soon as possible to ensure that its continuance is justified. The
action taken shall be immediately reported to contracting parties concerned,
the Secretary, and any regional plant protection organization of which the
contracting party is a member.
Article VIII
International
cooperation
1. The
contracting parties shall cooperate with one another to the fullest practicable
extent in achieving the aims of this Convention, and shall in particular:
a) cooperate in the exchange of information on
plant pests, particularly the reporting of the occurrence, outbreak or spread
of pests that may be of immediate or potential danger, in accordance with such
procedures as may be established by the Commission;
b) participate, in so far as is practicable, in
any special campaigns for combatting pests that may seriously threaten crop
production and need international action to meet the emergencies; and
c) cooperate, to the extent practicable, in
providing technical and biological information necessary for pest risk
analysis.
2. Each
contracting party shall designate a contact point for the exchange of
information connected with the implementation of this Convention.
Article IX
Regional
plant protection organizations
1. The
contracting parties undertake to cooperate with one another in establishing
regional plant protection organizations in appropriate areas.
2. The regional
plant protection organizations shall function as the coordinating bodies in the
areas covered, shall participate in various activities to achieve the
objectives of this Convention and, where appropriate, shall gather and
disseminate information.
3. The regional
plant protection organizations shall cooperate with the Secretary in achieving
the objectives of the Convention and, where appropriate, cooperate with the
Secretary and the Commission in developing international standards.
4. The
Secretary will convene regular Technical Consultations of representatives of
regional plant protection organizations to:
a) promote the development and use of relevant
international standards for phytosanitary measures; and
b) encourage inter-regional cooperation in
promoting harmonized phytosanitary measures for controlling pests and in
preventing their spread and/or introduction.
Article X
Standards
1. The
contracting parties agree to cooperate in the development of international
standards in accordance with the procedures adopted by the Commission.
2.
International standards shall be adopted by the Commission.
3. Regional
standards should be consistent with the principles of this Convention; such
standards may be deposited with the Commission for consideration as candidates
for international standards for phytosanitary measures if more broadly
applicable.
4. Contracting
parties should take into account, as appropriate, international standards when
undertaking activities related to this Convention.
Article XI
Commission
on Phytosanitary Measures
1. Contracting
parties agree to establish the Commission on Phytosanitary Measures within the
framework of the Food and Agriculture Organization of the United Nations (FAO).
2. The
functions of the Commission shall be to promote the full implementation of the
objectives of the Convention and, in particular, to:
a) review the state of plant protection in the
world and the need for action to control the international spread of pests and
their introduction into endangered areas;
b) establish and keep under review the necessary
institutional arrangements and procedures for the development and adoption of
international standards, and to adopt international standards;
c) establish rules and procedures for the
resolution of disputes in accordance with Article XIII;
d) establish such subsidiary bodies of the
Commission as may be necessary for the proper implementation of its functions;
e) adopt guidelines regarding the recognition of
regional plant protection organizations;
f) establish cooperation with other relevant
international organizations on matters covered by this Convention;
g) adopt such recommendations for the
implementation of the Convention as necessary; and
h) perform such other functions as may be
necessary to the fulfilment of the objectives of this Convention.
3. Membership in the Commission shall be open to all contracting
parties.
4. Each contracting party may be represented at sessions of the
Commission by a single delegate who may be accompanied by an alternate, and by
experts and advisers. Alternates, experts and advisers may take part in the
proceedings of the Commission but may not vote, except in the case of an
alternate who is duly authorized to substitute for the delegate.
5. The contracting parties shall make every effort to reach agreement on
all matters by consensus. If all efforts to reach consensus have been exhausted
and no agreement is reached, the decision shall, as a last resort, be taken by
a two-thirds majority of the contracting parties present and voting.
6. A member organization of FAO that is a contracting party and the
member states of that member organization that are contracting parties shall
exercise their membership rights and fulfil their membership obligations in
accordance, mutatis mutandis, with the Constitution and General
Rules of FAO.
7. The Commission may adopt and amend, as required, its own Rules of
Procedure, which shall not be inconsistent with this Convention or with the
Constitution of FAO.
8. The Chairperson of the Commission shall convene an annual regular
session of the Commission.
9. Special sessions of the Commission shall be convened by the
Chairperson of the Commission at the request of at least one-third of its
members.
10. The Commission shall elect its Chairperson and no more than two
Vice-Chairpersons, each of whom shall serve for a term of two years.
Article XII
Secretariat
1. The Secretary of the Commission shall be appointed by the
Director-General of FAO.
2. The Secretary shall be assisted by such secretariat staff as may be
required.
3. The Secretary shall be responsible for implementing the policies and
activities of the Commission and carrying out such other functions as may be
assigned to the Secretary by this Convention and shall report thereon to the
Commission.
4. The Secretary shall disseminate:
a) international standards to all contracting
parties within sixty days of adoption;
b) to all contracting parties, lists of points of
entry under Article VII paragraph 2(d) communicated by contracting
parties;
c) lists of regulated pests whose entry is
prohibited or referred to in Article VII paragraph 2(i) to all contracting
parties and regional plant protection organizations;
d) information received from contracting parties
on phytosanitary requirements, restrictions and prohibitions referred to in
Article VII paragraph 2(b), and descriptions of official national plant
protection organizations referred to in Article IV paragraph 4.
5. The Secretary shall provide translations in the official languages of
FAO of documentation for meetings of the Commission and international
standards.
6. The Secretary shall cooperate with regional plant protection
organizations in achieving the aims of the Convention.
Article XIII
Settlement
of disputes
1. If there is
any dispute regarding the interpretation or application of this Convention, or
if a contracting party considers that any action by another contracting party
is in conflict with the obligations of the latter under Articles V and VII of
this Convention, especially regarding the basis of prohibiting or restricting
the imports of plants, plant products or other regulated articles coming from
its territories, the contracting parties concerned shall consult among
themselves as soon as possible with a view to resolving the dispute.
2. If the
dispute cannot be resolved by the means referred to in paragraph 1, the
contracting party or parties concerned may request the Director-General of FAO
to appoint a committee of experts to consider the question in dispute, in
accordance with rules and procedures that may be established by the Commission.
3. This
Committee shall include representatives designated by each contracting party
concerned. The Committee shall consider the question in dispute, taking into
account all documents and other forms of evidence submitted by the contracting
parties concerned. The Committee shall prepare a report on the technical
aspects of the dispute for the purpose of seeking its resolution. The
preparation of the report and its approval shall be according to rules and
procedures established by the Commission, and it shall be transmitted by the
Director-General to the contracting parties concerned. The report may also be
submitted, upon its request, to the competent body of the international
organization responsible for resolving trade disputes.
4. The
contracting parties agree that the recommendations of such a committee, while
not binding in character, will become the basis for renewed consideration by
the contracting parties concerned of the matter out of which the disagreement
arose.
5. The
contracting parties concerned shall share the expenses of the experts.
6. The
provisions of this Article shall be complementary to and not in derogation
of the dispute settlement procedures provided for in other international agreements
dealing with trade matters.
Article XIV
Substitution
of prior agreements
This Convention
shall terminate and replace, between contracting parties, the International
Convention respecting measures to be taken against the Phylloxera vastatrix of 3 November 1881, the additional
Convention signed at Berne on 15 April 1889 and the International Convention
for the Protection of Plants signed at Rome on 16 April 1929.
Article XV
Territorial
application
1. Any
contracting party may at the time of ratification or adherence or at any time
thereafter communicate to the Director-General of FAO a declaration that this
Convention shall extend to all or any of the territories for the international
relations of which it is responsible, and this Convention shall be applicable
to all territories specified in the declaration as from the thirtieth day after
the receipt of the declaration by the Director-General.
2. Any
contracting party which has communicated to the Director-General of FAO a
declaration in accordance with paragraph 1 of this Article may at any time
communicate a further declaration modifying the scope of any former declaration
or terminating the application of the provisions of the present Convention in
respect of any territory. Such modification or termination shall take effect as
from the thirtieth day after the receipt of the declaration by the
Director-General.
3. The
Director-General of FAO shall inform all contracting parties of any declaration
received under this Article.
Article XVI
Supplementary
agreements
1. The
contracting parties may, for the purpose of meeting special problems of plant
protection which need particular attention or action, enter into supplementary
agreements. Such agreements may be applicable to specific regions, to specific
pests, to specific plants and plant products, to specific methods of
international transportation of plants and plant products, or otherwise
supplement the provisions of this Convention.
2. Any such supplementary agreements shall come into force for each
contracting party concerned after acceptance in accordance with the provisions
of the supplementary agreements concerned.
3. Supplementary agreements shall promote the intent of this Convention
and shall conform to the principles and provisions of this Convention, as well
as to the principles of transparency, non-discrimination and the avoidance of
disguised restrictions, particularly on international trade.
Article XVII
Ratification and adherence
1. This Convention shall be open for signature by all states until
1 May 1952 and shall be ratified at the earliest possible date. The
instruments of ratification shall be deposited with the Director-General of
FAO, who shall give notice of the date of deposit to each of the signatory
states.
2. As soon as this Convention has come into force in accordance with
Article XXII it shall be open for adherence by non-signatory states and
member organizations of FAO. Adherence shall be effected by the deposit of an
instrument of adherence with the DirectorGeneral of FAO, who shall notify all
contracting parties.
3. When a member organization of FAO becomes a contracting party to this
Convention, the member organization shall, in accordance with the provisions of
Article II paragraph 7 of the FAO Constitution, as appropriate, notify at
the time of its adherence such modifications or clarifications to its
declaration of competence submitted under Article II paragraph 5 of the
FAO Constitution as may be necessary in light of its acceptance of this
Convention. Any contracting party to this Convention may, at any time, request
a member organization of FAO that is a contracting party to this Convention to
provide information as to which, as between the member organization and its
member states, is responsible for the implementation of any particular matter
covered by this Convention. The member organization shall provide this
information within a reasonable time.
Article XVIII
Non-contracting parties
The contracting parties shall encourage any state or member organization
of FAO, not a party to this Convention, to accept this Convention, and shall
encourage any non-contracting party to apply phytosanitary measures consistent
with the provisions of this Convention and any international standards adopted
hereunder.
Article XIX
Languages
1. The authentic languages of this Convention shall be all official
languages of FAO.
2. Nothing in this Convention shall be construed as requiring
contracting parties to provide and to publish documents or to provide copies of
them other than in the language(s) of the contracting party, except as stated
in paragraph 3 below.
3. The following documents shall be in at least one of the official
languages of FAO:
a) information provided according to
Article IV paragraph 4;
b) cover notes giving bibliographical data on
documents transmitted according to Article VII paragraph 2(b);
c) information provided according to
Article VII paragraph 2(b), (d), (i) and (j);
d) notes giving bibliographical data and a short
summary of relevant documents on information provided according to
Article VIII paragraph 1(a);
e) requests for information from contact points as
well as replies to such requests, but not including any attached documents;
f) any document made available by contracting
parties for meetings of the Commission.
Article XX
Technical assistance
The contracting parties agree to promote the provision of technical
assistance to contracting parties, especially those that are developing
contracting parties, either bilaterally or through the appropriate
international organizations, with the objective of facilitating the
implementation of this Convention.
Article XXI
Amendment
1. Any proposal by a contracting party for the amendment of this
Convention shall be communicated to the Director-General of FAO.
2. Any proposed amendment of this Convention received by the
Director-General of FAO from a contracting party shall be presented to a
regular or special session of the Commission for approval and, if the amendment
involves important technical changes or imposes additional obligations on the
contracting parties, it shall be considered by an advisory committee of
specialists convened by FAO prior to the Commission.
3. Notice of any proposed amendment of this Convention, other than
amendments to the Annex, shall be transmitted to the contracting parties by the
Director-General of FAO not later than the time when the agenda of the session
of the Commission at which the matter is to be considered is dispatched.
4. Any such proposed amendment of this Convention shall require the
approval of the Commission and shall come into force as from the thirtieth day
after acceptance by two-thirds of the contracting parties. For the purpose of this
Article, an instrument deposited by a member organization of FAO shall not be
counted as additional to those deposited by member states of such an
organization.
5. Amendments involving new obligations for contracting parties,
however, shall come into force in respect of each contracting party only on
acceptance by it and as from the thirtieth day after such acceptance. The
instruments of acceptance of amendments involving new obligations shall be
deposited with the Director-General of FAO, who shall inform all contracting
parties of the receipt of acceptance and the entry into force of amendments.
6. Proposals for amendments to the model phytosanitary certificates set
out in the Annex to this Convention shall be sent to the Secretary and shall be
considered for approval by the Commission. Approved amendments to the model
phytosanitary certificates set out in the Annex to this Convention shall become
effective ninety days after their notification to the contracting parties by
the Secretary.
7. For a period of not more than twelve months from an amendment to the
model phytosanitary certificates set out in the Annex to this Convention
becoming effective, the previous version of the phytosanitary certificates
shall also be legally valid for the purpose of this Convention.
Article XXII
Entry into force
As soon as this Convention has been ratified by three signatory states
it shall come into force among them. It shall come into force for each state or
member organization of FAO ratifying or adhering thereafter from the date of
deposit of its instrument of ratification or adherence.
Article XXIII
Denunciation
1. Any contracting party may at any time give notice of denunciation of
this Convention by notification addressed to the Director-General of FAO. The
Director-General shall at once inform all contracting parties.
2. Denunciation shall take effect one year from the date of receipt of
the notification by the Director-General of FAO.

PRÉAMBULE
Les parties
contractantes,
reconnaissant la nécessité d’une coopération
internationale en matière de lutte contre les organismes nuisibles aux végétaux
et aux produits végétaux, et afin de prévenir leur dissémination internationale
et spécialement leur introduction dans des zones menacées;
reconnaissant que les mesures phytosanitaires devraient
être techniquement justifiées et transparentes et ne devraient pas être
appliquées d’une manière telle qu’elles constituent soit un moyen de discrimination
arbitraire ou injustifié, soit une restriction déguisée, notamment au commerce
international;
désireuses d’assurer une étroite
coordination des
mesures visant à ces fins, souhaitant définir un cadre pour la mise au point de
l’application de mesures phytosanitaires harmonisées et l’élaboration de normes
internationales à cet effet;
tenant compte des principes approuvés sur le plan
international régissant la protection de la santé des végétaux, de l’homme et
des animaux ainsi que de l’environnement;
notant les accords conclus à l’issue cbs
Négociations commerciales multilatérales du Cycle d’Uruguay et, notamment,
l’Accord sur l’application des mesures sanitaires et phytosanitaires;sont
convenues de ce qui suit:
Article I
Objet et obligations
1. En vue d’assurer
une action commune et efficace afin de prévenir la dissémination et
l’introduction d’organismes nuisibles aux végétaux et produits végétaux, et en
vue de promouvoir l’adoption de mesures appropriées de lutte contre ces
derniers, les parties contractantes s’engagent à prendre les mesures
législatives, techniques et réglementaires spécifiées dans la présente
Convention et dans les accords complémentaires conformément à
l’Article XVI.
2. Chaque partie contractante s’engage, sans préjudice des obligations
contractées en vertu d’autres accords internationaux, à veiller, sur son
territoire, à l’application des mesures prescrites par la présente Convention.
3. La répartition des responsabilités entre les organisations membres de la
FAO et leurs États membres qui sont parties contractantes à la présente
Convention pour l’application des mesures prescrites par celles-ci, se fera
conformément à leurs compétences respectives.
4. Selon les nécessités, les dispositions de la présente Convention
peuvent, si les parties contractantes le jugent utiles, s’appliquer, outre aux
végétaux et produits végétaux, également aux lieux de stockage, emballages,
moyens de transport, conteneurs, terre et autres organismes, objets ou
matériels de toute nature susceptibles de porter ou de disséminer des
organismes nuisibles, en particulier à ceux qui interviennent dans le transport
international.
Article II
Terminologie
1. Dans la présente
Convention, les termes ci-après sont définis comme suit:
– «Analyse du risque phytosanitaire» – processus consistant à évaluer les
preuves biologiques ou autres données scientifiques ou économiques pour
déterminer si un organisme nuisible doit être réglementé, et la sévérité des
mesures phytosanitaires éventuelles à prendre à son égard;
– «Article réglementé» – tout végétal, produit végétal, lieu de stockage,
emballage, moyen de transport, conteneur, terre et tout autre organisme, objet
ou matériel susceptible de porter ou de disséminer des organismes nuisibles
justifiant des mesures phytosanitaires, particulièrement pour tout ce qui
concerne les transports internationaux;
– «Commission» – la Commission des mesures
phytosanitaires créée en vertu de l’Article XI;
– «Etablissement» – perpétuation, dans un avenir prévisible, d’un organisme
nuisible dans une zone après son entrée;
– «Introduction» – entrée d’un organisme
nuisible, suivie de son établissement;
– «Mesure phytosanitaire» – toute législation, réglementation ou méthode
officielle ayant pour objectif de prévenir l’introduction et/ou la dissémination
des organismes nuisibles;
– «Mesures phytosanitaires harmonisées» – mesures
phytosanitaires mises en place par des parties contractantes sur la base de
normes internationales;
– «Normes internationales»- normes internationales établies conformément à
l’Article X paragraphes 1 et 2;
– «Normes régionales» – normes établies par une
organisation régionale de la protection des végétaux à l’intention de ses
membres;
– «Organisme de quarantaine» – organisme nuisible qui a une importance
potentielle pour l’économie de la zone menacée et qui n’est pas encore présent
dans cette zone ou bien qui y est présent mais n’y est pas largement disséminé
et fait l’objet d’une lutte officielle;
– «Organisme nuisible» – toute espèce, souche ou
biotype de végétal, d’animal ou d’agent pathogène nuisible pour les végétaux ou
produits végétaux;
– «Organisme nuisible réglementé» – organisme de quarantaine ou organisme
réglementé non de quarantaine;
– «Organisme réglementé non de quarantaine» –
organisme nuisible qui n’est pas un organisme de quarantaine, dont la présence
dans les végétaux destinés à la plantation affecte l’usage prévu de ces
végétaux, avec une incidence économique inacceptable et qui est donc réglementé
sur le territoire de la partie contractante importatrice;
– «Produits végétaux» – produits non manufacturés d’origine végétale (y
compris les grains) ainsi que les produits manufacturés qui, étant donné leur
nature ou celle de leur transformation, peuvent constituer un risque
d’introduction ou de dissémination des organismes nuisibles;
– «Secrétaire» – le Secrétaire de la Commission
nommé conformément à l’Article XII;
– «Techniquement justifié» – justifié sur la base des conclusions d’une
analyse appropriée du risque phytosanitaire ou, le cas échéant, d’autres
examens ou évaluations comparables des données scientifiques disponibles;
– «Végétaux» – plantes vivantes et parties de
plantes vivantes, y compris les semences et le matériel génétique;
– «Zone à faible prévalence d’organismes nuisibles» – zone, qu’il s’agisse de
la totalité d’un pays, d’une partie d’un pays ou de la totalité ou de parties
de plusieurs pays, identifiée par les autorités compétentes, dans laquelle un
organisme nuisible spécifique est présent à un niveau faible et qui fait l’objet
de mesures efficaces de surveillance, de lutte ou d’éradication;
– «Zone menacée» – zone où les facteurs
écologiques sont favorables à l’établissement d’un organisme nuisible dont la
présence entraînerait des pertes économiquement importantes.
2. Les définitions
données dans cet Article étant limitées à l’application de la présente
Convention, elles sont réputées ne pas affecter les définitions données dans
les lois ou règlements des parties contractantes.
Article III
Relations
avec dáutres accords internationaux
La présente
Convention s’appliquera sans préjudice des droits et obligations des parties
contractantes découlant d’accords internationaux pertinents.
Article IV
Dispositions
générales relatives aux modalités d’organisation de la protection nationale des
végétaux
1. Chaque partie
contractante s’engage à prendre les dispositions nécessaires pour mettre en
place, dans la mesure de ses possibilités, une organisation nationale
officielle de la protection des végétaux dont les principales responsabilités
sont définies dans le présent article.
2. L’organisation
nationale officielle de la protection des végétaux aura notamment les
responsabilités suivantes:
a) la délivrance de certificats relatifs à la
réglementation phytosanitaire de la partie contractante importatrice pour les
envois de végétaux, produits végétaux et autres articles réglementés;
b) la surveillance des végétaux sur pied, y
compris les terres cultivées (notamment les champs, les plantations, les
pépinières, les jardins, les serres et les laboratoires) et la flore sauvage,
et des végétaux et produits végétaux entreposés ou en cours de transport, en
vue particulièrement de signaler la présence, l’apparition et la dissémination
des organismes nuisibles, et de lutter contre ces organismes nuisibles, y
compris l’établissement de rapports mentionnés à l’Article VIII paragraphe
1 (a);
c) l’inspection des envois de végétaux et produits
végétaux faisant l’objet d’échanges internationaux et, si besoin est,
l’inspection d’autres articles réglementés, en vue notamment d’empêcher
l’introduction et/ou la dissémination des organismes nuisibles;
d) la désinfestation ou la désinfection des envois
de végétaux, produits végétaux et autres articles réglementés faisant l’objet
d’échanges internationaux pour respecter les exigences phytosanitaires;
e) la protection des zones menacées et la
désignation, le maintien et la surveillance de zones indemnes et de zones à
faible prévalence d’organismes nuisibles;
f) la conduite d’analyses du risque
phytosanitaire;
g) garantir, grâce à des procédures appropriées,
que la sécurité phytosanitaire des envois après certification est maintenue
jusqu’à l’exportation, afin d’éviter toute modification de leur composition,
ainsi que toute substitution ou réinfestation;
h) la formation et la valorisation des ressources
humaines.
3. Chaque partie
contractante s’engage à prendre les dispositions nécessaires pour garantir,
dans la mesure de ses moyens:
a) la distribution, sur le territoire de la partie
contractante, de renseignements sur les organismes nuisibles réglementés et les
moyens de prévention et de lutte;
b) la recherche et l’enquête dans le domaine de la
protection des végétaux;
c) la promulgation de la réglementation
phytosanitaire;
d) l’exécution de toute autre fonction pouvant
être exigée pour l’application de la présente Convention.
4. Chaque partie
contractante présentera au Secrétaire un rapport décrivant son organisation
nationale officielle chargée de la protection des végétaux et les modifications
qui sont apportées à cette organisation. Les parties contractantes fourniront,
sur demande, à toute autre partie contractante, des informations sur les
modalités d’organisation de la protection des végétaux.
Article V
Certification
phytosanitaire
1. Chaque partie
contractante prendra les dispositions nécessaires concernant la certification
phytosanitaire, dans le but de garantir que les envois de végétaux, produits
végétaux et autres articles réglementés exportés soient conformes à la déclaration
de certification à effectuer en vertu du paragraphe 2 (b) du présent article.
2. Chaque partie
contractante prendra les dispositions nécessaires pour délivrer des certificats
phytosanitaires conformes aux dispositions suivantes:
a) l’inspection et les autres activités
nécessaires à l’établissement des certificats phytosanitaires ne pourront être
confiées qu’à l’organisation nationale de la protection des végétaux ou des
personnes placées sous son autorité directe. La délivrance des certificats
phytosanitaires sera confiée à des fonctionnaires techniquement qualifiés et
dûment autorisés par l’organisation nationale de la protection des végétaux
pour agir pour son compte et sous son contrôle, disposant des connaissances et
des renseignements nécessaires de telle sorte que les autorités des parties
contractantes importatrices puissent accepter les certificats phytosanitaires
comme des documents dignes de foi;
b) les certificats phytosanitaires, ou leur
version électronique si celle-ci est acceptée par la partie contractante
importatrice, devront être libellés conformément aux modèles reproduits en
annexe à la présente Convention. Ces certificats seront établis et délivrés en
prenant en considération les normes internationales en vigueur;
c) les corrections ou suppressions non certifiées
invalideront les certificats.
3. Chaque partie
contractante s’engage à ne pas exiger, pour accompagner les envois de végétaux,
produits végétaux ou autres articles réglementés importés dans son territoire,
de certificats phytosanitaires non conformes aux modèles reproduits en annexe à
la présente Convention. Toute déclaration supplémentaire exigée devra être
justifiée d’un point de vue technique.
Article VI
Organismes nuisibles réglementés
1. Les parties
contractantes peuvent demander l’application de mesures phytosanitaires pour
les organismes de quarantaine et les organismes réglementés non de quarantaine,
à condition que de telles mesures:
a) ne soient pas plus restrictives que les mesures
appliquées aux mêmes organismes nuisibles s’ils sont présents sur le territoire
de la partie contractante importatrice; et
b) soient limitées aux dispositions nécessaires
pour protéger la santé des végétaux et/ou sauvegarder l’usage auquel ils sont
destinés et soient justifiées d’un point de vue technique par la partie
contractante concernée.
2. Les parties
contractantes ne pourront demander l’application des mesures phytosanitaires
dans le commerce international pour des organismes nuisibles non réglementés.
Article VII
Dispositions concernant les importations
1. Les parties
contractantes ont le pouvoir souverain de réglementer, conformément aux accords
internationaux en vigueur, l’importation de végétaux, produits végétaux et
autres articles réglementés, afin d’empêcher l’introduction et/ou la
dissémination d’organismes nuisibles réglementés sur leur territoire et, à
cette fin, elles peuvent:
a) prescrire et adopter des mesures
phytosanitaires concernant l’importation des végétaux, des produits végétaux et
d’autres articles réglementés, notamment l’inspection, l’interdiction
d’importer et le traitement;
b) interdire l’entrée ou détenir, ou exiger le
traitement, la destruction ou le refoulement hors du pays de la partie
contractante, des envois de végétaux, produits végétaux et autres articles
réglementés qui ne sont pas conformes aux mesures phytosanitaires prescrites ou
adoptées aux termes de l’alinéa (a) ci-dessus;
c) interdire ou restreindre l’entrée sur leur
territoire des organismes nuisibles réglementés;
d) interdire ou restreindre l’entrée sur leur
territoire d’agents de lutte biologique et d’autres organismes d’importance
phytosanitaire réputés bénéfiques.
2. Afin d’entraver le
moins possible le commerce international, chaque partie contractante, dans
l’exercice de son pouvoir aux termes du paragraphe 1 du présent article,
s’engage à agir en se conformant aux dispositions suivantes:
a) les parties contractantes ne doivent prendre,
en vertu de leur réglementation phytosanitaire, aucune des mesures mentionnées
au paragraphe 1 du présent article, à moins que celles-ci répondent à des
nécessités d’ordre phytosanitaire et soient techniquement justifiées;
b) les parties contractantes doivent,
immédiatement après avoir adopté, publié et communiqué les exigences,
restrictions et interdictions phytosanitaires à toute partie contractante ou
aux parties qu’elles jugent pouvoir être directement affectées par de telles
mesures;
c) les parties contractantes devront, sur demande,
faire connaître à toute partie contractante les raisons de ces exigences,
restrictions et interdictions phytosanitaires;
d) toute partie contractante qui limite les points
d’entrée pour l’importation de certains végétaux ou produits végétaux doit
choisir lesdits points de manière à ne pas entraver sans nécessité le commerce
international. La partie contractante doit publier une liste desdits points et
la communiquer au Secrétaire, à toute organisation régionale de la protection
des végétaux à laquelle la partie contractante pourrait appartenir, à toute
partie contractante que la partie contractante juge pouvoir être directement
affectée et aux autres parties contractantes qui en font la demande. Toute
restriction de cet ordre ne sera autorisée que si les végétaux, produits végétaux
ou autres articles réglementés en cause sont accompagnés de certificats
phytosanitaires ou soumis à une inspection ou à un traitement;
e) toute inspection, ou autre procédure
phytosanitaire requise par l’organisation de la protection des végétaux d’une
partie contractante pour un envoi de végétaux, produits végétaux ou autres
articles réglementés, destiné à l’importation doit s’effectuer dans le plus
bref délai possible, en tenant dûment compte de leur nature périssable;
f) les parties contractantes importatrices devront
signaler dès que possible à la partie contractante exportatrice concernée ou,
le cas échéant, à la partie contractante réexportatrice concernée les cas
importants de non-conformité à la certification phytosanitaire. La partie contractante
exportatrice ou, le cas échéant, la partie contractante réexportatrice
concernée, procédera à des recherches et communiquera, sur demande, les
résultats de celles-ci à la partie contractante importatrice concernée;
g) les parties contractantes doivent instituer
uniquement les mesures phytosanitaires qui sont techniquement justifiées et
adaptées aux risques encourus, qui représentent les mesures les moins
restrictives possibles et qui entravent au minimum les mouvements
internationaux de personnes, de marchandises et de moyens de transport;
h) à mesure que la situation évolue et que des
faits nouveaux interviennent, les parties contractantes doivent s’assurer dans
les plus brefs délais que les mesures phytosanitaires sont modifiées ou
supprimées si elles s’avèrent inutiles;
i) les parties contractantes doivent, du mieux
qu’elles le peuvent, dresser et tenir à jour les listes d’organismes nuisibles
réglementés, désignés par leur nom scientifique, et adresser périodiquement de
telles listes au Secrétaire, aux organisations régionales de la protection des
végétaux quand elles sont membres et, sur demande, à d’autres parties
contractantes;
j) les parties contractantes surveilleront, du
mieux qu’elles le peuvent, les organismes nuisibles et tiendront à jour des
informations adéquates sur leur situation afin de faciliter leur catégorisation
et la prise de mesures phytosanitaires appropriées. Les informations seront
portées, sur demande, à la connaissance des parties contractantes.
3. Les parties
contractantes peuvent appliquer les mesures prévues dans le présent
Article à des organismes nuisibles qui ne seront probablement pas capables
de s’établir sur leurs territoires mais qui, s’ils étaient introduits,
pourraient provoquer des dégâts d’importance économique. Les mesures prises
pour lutter contre les organismes nuisibles doivent être techniquement
justifiées.
4. Les parties
contractantes peuvent appliquer les dispositions du présent Article aux
envois en transit sur leurs territoires uniquement lorsque de telles mesures
sont justifiées d’un point de vue technique et nécessaires pour empêcher
l’introduction et/ou la dissémination des organismes nuisibles.
5. Aucune disposition
du présent Article n’empêche les parties contractantes importatrices de
prendre des mesures particulières, sous réserve des garanties appropriées,
concernant l’importation aux fins de la recherche scientifique, à des fins
éducatives ou à des usages spécifiques, de végétaux et produits végétaux et
autres articles réglementés, ainsi que d’organismes nuisibles.
6. Aucune disposition
du présent Article n’empêche les parties contractantes de prendre des
mesures d’urgence appropriées suite à la détection d’un organisme nuisible
représentant des menaces potentielles pour leur territoire, ou suite à un
rapport concernant une telle détection. Toute mesure de cet ordre doit être
évaluée dès que possible afin de s’assurer que sa poursuite est justifiée. Les
mesures ainsi prises doivent être immédiatement signalées aux parties
contractantes concernées, au Secrétaire, et à toute organisation régionale de
la protection des végétaux dont la partie contractante est membre.
Article VIII
Collaboration internationale
1. Les parties
contractantes collaboreront dans toute la mesure possible à la réalisation des
objectifs de la présente Convention, et en particulier:
a) coopéreront à l’échange d’informations sur les
organismes nuisibles, en particulier la notification de la présence, de
l’apparition ou de la dissémination d’organismes nuisibles pouvant présenter un
danger immédiat ou potentiel, conformément aux procédures qui pourront être
établies par la Commission;
b) participeront, dans toute la mesure possible, à
toute campagne spéciale de lutte contre des organismes nuisibles pouvant
menacer sérieusement les récoltes et exigeant une action internationale pour
parer aux situations d’urgence;
c) coopéreront, dans toute la mesure possible, à
la fourniture des données techniques et biologiques nécessaires à l’analyse du
risque phytosanitaire.
2. Chaque partie
contractante doit désigner un point de contact pour les échanges d’informations
concernant l’application de la présente Convention.
Article IX
Organisations régionales de la protection des
végétaux
1. Les parties
contractantes s’engagent à collaborer pour établir, dans les régions
appropriées, des organisations régionales de la protection des végétaux.
2. Ces organisations
doivent exercer un rôle coordonnateur dans les régions de leur compétence,
prendre part à différentes activités pour atteindre les objectifs de la
présente Convention et, le cas échéant, rassembler et diffuser des
informations.
3. Les organisations
régionales de la protection des végétaux coopéreront avec le Secrétaire en vue
de réaliser les objectifs de la présente Convention et, le cas échéant,
coopéreront avec le Secrétaire et la Commission pour l’élaboration de normes
internationales.
4. Le Secrétaire
convoquera des consultations techniques régulières des représentants des
organisations régionales de la protection des végétaux pour:
a) promouvoir l’établissement et l’utilisation de
normes internationales appropriées concernant les mesures phytosanitaires;
b) encourager une coopération interrégionale pour
la promotion de mesures phytosanitaires harmonisées pour la lutte contre les
organismes nuisibles et pour prévenir leur dissémination et/ou leur
introduction.
Article X
Normes
1. Les parties
contractantes s’engagent à coopérer à l’élaboration de normes internationales,
conformément aux procédures adoptées par la Commission.
2. Ces normes
internationales seront adoptées par la Commission.
3. Les normes
régionales devraient être conformes aux principes de la présente Convention;
ces normes peuvent être déposées auprès de la Commission pour examen afin
d’envisager de les transformer en normes internationales pour les mesures
phytosanitaires si elles sont plus largement applicables.
4. Les parties
contractantes devraient tenir compte, le cas échéant, des normes
internationales lorsqu’elles entreprennent des activités liées à la présente
Convention.
Article XI
Commission des mesures phytosanitaires
1. Les parties
contractantes s’engagent à créer la Commission des mesures phytosanitaires dans
le cadre de l’Organisation des Nations Unies pour l’alimentation et
l’agriculture (FAO).
2. La Commission aura
pour fonctions de promouvoir la pleine réalisation des objectifs de la présente
Convention et, en particulier:
a) de suivre la situation en ce qui concerne la
protection des végétaux dans le monde et la nécessité d’agir pour empêcher la
dissémination internationale des organismes nuisibles et leur introduction dans
les zones menacées;
b) de mettre en place et de revoir périodiquement
les dispositions et les procédures institutionnelles nécessaires pour
l’élaboration et l’adoption des normes internationales, ainsi que d’adopter ces
normes internationales;
c) de fixer des règles et procédures pour le
règlement des différends, conformément à l’Article XIII:
d) de créer les organismes subsidiaires qu’elle
jugera nécessaires pour s’acquitter correctement de ses fonctions;
e) d’adopter des directives concernant la
reconnaissance des organisations régionales de la protection des végétaux;
f) d’établir une coopération avec les autres
organisations internationales compétentes dans les domaines visés par la
présente Convention;
g) d’adopter toute recommandation qu’elle jugera
utile à l’application de la présente Convention;
h) de s’acquitter de toute autre fonction
nécessaire à la réalisation des objectifs de la présente Convention.
3. La Commission sera
ouverte à toutes les parties contractante.
4. Chaque partie
contractante peut être représentée aux sessions de la Commission par un
délégué, qui peut être accompagné d’un suppléant, ainsi que d’experts et de
conseillers. Les suppléants, les experts et les conseillers peuvent participer
aux délibérations de la Commission mais ne sont pas autorisés à voter, sauf
dans le cas où un suppléant est dûment autorisé à remplacer un délégué.
5. Les parties
contractantes feront leur possible pour parvenir à un accord sur toutes les
questions par consensus. Si toutes les tentatives pour parvenir à un accord par
consensus échouent, la décision sera prise, en dernier ressort, par la majorité
des deux tiers des parties contractantes présentes et votantes.
6. Une organisation
membre de la FAO qui est partie contractante et les États membres de cette
organisation qui sont parties contractantes exercent les droits et s’acquittent
des obligations liés à leur qualité de membre, conformément, mutatis mutandis, à l’Acte constitutif et au Règlement général de
la FAO.
7. La Commission peut
adopter et modifier, au besoin, son propre Règlement intérieur, qui ne doit pas
être incompatible avec les dispositions de la présente Convention ni de l’Acte
constitutif de la FAO.
8. Le Président de la Commission convoque tous les ans une session
ordinaire de la Commission.
9. Des sessions extraordinaires de la Commission seront convoquées par le
Président de la Commission à la demande d’au moins un tiers de ses membres.
10. La Commission élit son Président et au maximum deux Vice-Présidents,
qui restent chacun en fonction pour un mandat de deux ans.
Article XII
Secrétariat
1. Le Secrétaire de la Commission est nommé par le Directeur général de la
FAO.
2. Le Secrétaire est secondé, selon les besoins, par du personnel de
secrétariat.
3. Le Secrétaire est responsable de la mise en oeuvre des politiques et
activités de la Commission et de toute autre fonction qui lui est attribuée aux
termes des dispositions de la présente Convention, et il fait rapport à ce
sujet à la Commission.
4. Le Secrétaire se charge de la diffusion:
a) des normes internationales auprès de toutes les
parties contractantes, dans un délai maximum de soixante jours à compter de
leur adoption;
b) des listes reçues des parties contractantes sur
les points d’entrée, comme prévu à l’Article VII paragraphe 2 (d), auprès
de toutes les parties contractantes;
c) des listes d’organismes nuisibles réglementés,
dont l’introduction est interdite ou auxquels il est fait référence à
l’Article VII paragraphe 2 (i) auprès de toutes les parties contractantes
et organisations régionales de la protection des végétaux;
d) des informations reçues des parties
contractantes sur les exigences, restrictions et interdictions phytosanitaires
visées à l’Article VII paragraphe 2 (b) et les descriptions des
organisations nationales officielles de la protection des végétaux visées à
l’Article IV paragraphe 4.
5. Le Secrétaire assurera la traduction dans les langues officielles de la
FAO de la documentation pour les réunions de la Commission et des normes
internationales.
6. Le Secrétaire coopérera avec les organisations régionales de la
protection des végétaux à la réalisation des objectifs de la présente
Convention.
Article XIII
Règlement des différends
1. En cas de contestation sur l’interprétation ou l’application de la
présente Convention, ou bien lorsqu’une partie contractante considère qu’une
action entreprise par une autre partie contractante est incompatible avec les
obligations qu’imposent à cette dernière les articles V et VII de la présente
Convention, particulièrement en ce qui concerne les motifs d’une interdiction
ou d’une restriction à l’importation de végétaux, produits végétaux ou autres
articles réglementés provenant de son territoire, les parties contractantes
intéressées se consultent dans les plus brefs délais en vue de régler le
différend.
2. Si le différend ne peut être réglé comme indiqué au paragraphe 1 du
présent article, la ou les partie(s) contractante(s) intéressée(s) peu(ven)t
demander au Directeur général de la FAO de désigner un comité d’experts chargé
d’examiner le différend conformément aux règles et procédures qui pourraient
être adoptées par la Commission.
3. Le Comité visé au paragraphe 2 du présent Article comprendra des
représentants désignés par chaque partie contractante concernée. Le Comité
examinera le différend en tenant compte de tous les documents et éléments
probatoires présentés par les parties contractantes intéressées. Le Comité
établira un rapport sur les aspects techniques du différend afin de chercher
une solution. Ledit rapport sera rédigé et approuvé conformément aux règles et
procédures établies par la Commission et sera transmis par le Directeur général
aux parties contractantes intéressées. Le rapport pourra également être
transmis, sur demande, à l’organe compétent de l’organisation internationale
chargée de régler les différends commerciaux.
4. Tout en ne
reconnaissant pas aux recommandations du Comité visé au paragraphe 2 du présent
Article un caractère obligatoire, les parties contractantes conviennent de
les prendre comme bases de tout nouvel examen, par les parties contractantes
intéressées, de la question qui est à l’origine du différend.
5. Les parties
contractantes intéressées partageront les frais de la mission confiée aux
experts.
6. Les dispositions
du présent Article constituent un complément et non une dérogation aux
procédures de règlement des différends prévues par d’autres accords
internationaux traitant de questions commerciales.
Article XIV
Substitution aux accords antérieurs
La présente
Convention met fin et se substitue, dans les relations entre les parties
contractantes, à la Convention internationale phylloxérique du 3 novembre 1881,
à la Convention additionnelle de Berne du 15 avril 1889 et à la Convention
internationale de Rome du 16 avril 1929 sur la protection des végétaux.
Article XV
Application territoriale
1. Toute partie
contractante peut, à la date de la ratification ou de l’adhésion, ou à tout
moment après cette date, communiquer au Directeur général de la FAO une
déclaration indiquant que la présente Convention est applicable à tout ou
partie des territoires dont elle assure la représentation sur le plan
international. Cette décision prendra effet trente jours après réception par le
Directeur général de la déclaration portant désignation desdits territoires.
2. Toute partie
contractante qui a transmis au Directeur général de la FAO une déclaration,
conformément au paragraphe 1 du présent article, peut à tout moment communiquer
une nouvelle déclaration modifiant la portée d’une déclaration précédente, ou
mettant fin à l’application des dispositions de la présente Convention dans
n’importe quel territoire. Cette déclaration prendra effet trente jours après
la date de sa réception par le Directeur général.
3. Le Directeur
général de la FAO informera toutes les parties contractantes des déclarations
qu’il aura reçues en application du présent article.
Article XVI
Accords complémentaires
1. Les parties
contractantes peuvent, afin de résoudre des problèmes spécifiques de protection
des végétaux nécessitant une attention ou un action particulière, conclure des
accords complémentaires. De tels accords peuvent être applicables à des
régions, à des organismes nuisibles, à des végétaux et produits végétaux
spécifiques, ainsi qu’à des modes spécifiques de transport international des
végétaux et produits végétaux, ou peuvent compléter de toute autre manière les
dispositions de la présente Convention.
2. Tout accord
complémentaire de cette nature entrera en vigueur, pour chaque partie
contractante concernée, après avoir été accepté conformément aux dispositions
des accords complémentaires concernés.
3. Les accords
complémentaires favoriseront les objectifs de la présente Convention et seront
conformes aux principes et dispositions de celle-ci, ainsi qu’aux principes de
transparence, de non-discrimination et de non-recours à des restrictions
déguisées, en particulier au commerce international.
Article XVII
Ratification et adhésion
1. La présente
Convention est ouverte à la signature de tous les États jusqu’au 1er mai 1952
et sera ratifiée le plus tôt possible. Les instruments de ratification seront
déposés auprès du Directeur général de la FAO, qui avisera chaque État
signataire de la date de ce dépôt.
2. Les États qui
n’ont pas signé la présente Convention et les organisations membres de la FAO
non signataires seront admis à y adhérer dès qu’elle sera entrée en vigueur
conformément à l’Article XXII. L’adhésion s’effectuera par le dépôt d’un
instrument d’adhésion auprès du Directeur général de la FAO qui en avisera
toutes les parties contractantes.
3. Quand une
organisation membre de la FAO devient partie contractante à la présente
Convention, elle doit, conformément aux dispositions de l’Article II
paragraphe 7 de l’Acte constitutif de la FAO, selon qu’il convient, notifier au
moment de son adhésion les modifications ou éclaircissements à la déclaration
de compétence qu’elle a soumise en vertu de l’Article II paragraphe 5 de
l’Acte constitutif de la FAO, si cela est nécessaire compte tenu de son
acceptation de la présente Convention. Toute partie contractante à la présente
Convention peut, à tout moment, demander à une organisation membre de la FAO qui
est partie contractante à ladite Convention d’indiquer qui, de l’organisation
membre ou de ses États membres, est responsable de la mise en oeuvre de telle
ou telle question visée par cette Convention. L’organisation membre devra
fournir cette information dans un délai raisonnable.
Article XVIII
Parties non
contractantes
Les parties
contractantes encourageront tout État ou toute organisation membre de la FAO
n’étant pas partie à la présente Convention à accepter cette dernière et elles
encourageront toute partie non contractante à appliquer des mesures
phytosanitaires compatibles avec les dispositions de la présente Convention et
avec toute norme internationale adoptée en vertu de celle-ci.
Article XIX
Langues
1. Les langues
authentiques de la présente Convention seront toutes les langues officielles de
la FAO.
2. Aucune disposition
de la présente Convention n’exige des parties contractantes la fourniture, la
publication ou la reproduction de documents dans des langues autres que
celle(s) de la partie contractante, sous réserve des exceptions indiquées au
paragraphe 3 du présent article.
3. Les documents
suivants seront rédigés dans au moins une des langues officielles de la FAO:
a) renseignements communiqués conformément à
l’Article IV paragraphe 4;
b) notes d’accompagnement indiquant les données
bibliographiques relatives aux documents transmis conformément à
l’Article VII paragraphe 2 (b);
c) renseignements communiqués conformément à
l’Article VII paragraphe 2 (b), (d), (i) et (j);
d) notes indiquant des données bibliographiques et
un bref résumé des documents concernant les renseignements communiqués
conformément à l’Article VIII paragraphe 1 (a);
e) demandes d’information adressées aux points de
contact et réponses à ces demandes à l’exception des éventuels documents
joints;
f) documents fournis par les parties contractantes
pour les réunions de la Commission.
Article XX
Assistance
technique
Les parties
contractantes s’engagent à promouvoir l’octroi d’une assistance technique aux
parties contractantes, notamment aux parties contractantes en développement,
par le biais de l’aide bilatérale ou des organisations internationales
appropriées, en vue de faciliter l’application de la présente Convention.
Article XXI
Amendement
1. Toute proposition
d’amendement à la présente Convention introduite par une partie contractante
doit être communiquée au Directeur général de la FAO.
2. Toute proposition
d’amendement à la présente Convention introduite par une partie contractante et
reçue par le Directeur général de la FAO doit être soumise pour approbation à
la Commission, réunie en session ordinaire ou extraordinaire. Si l’amendement
implique d’importantes modifications d’ordre technique ou impose de nouvelles
obligations aux parties contractantes, il sera étudié par un comité consultatif
d’experts convoqué par la FAO avant la Commission.
3. Toute proposition
d’amendement à la présente Convention, à l’exception des amendements à
l’annexe, sera notifiée aux parties contractantes par le Directeur général de
la FAO, au plus tard à la date de l’envoi de l’ordre du jour de la session de
la Commission où doit être examinée cette proposition.
4. Toute proposition
d’amendement à la présente Convention doit être adoptée par la Commission et
prend effet à compter du trentième jour qui suit son acceptation par les deux
tiers des parties contractantes. Aux fins du présent article, tout instrument
déposé par une organisation membre de la FAO ne sera pas considéré comme venant
s’ajouter aux instruments déposés par les États membres de cette organisation.
5. Les amendements
qui impliquent de nouvelles obligations à la charge des parties contractantes
ne prennent effet toutefois, vis-à-vis de chaque partie contractante, qu’après
avoir été acceptés par elle et à compter du trentième jour qui suit cette
acceptation. Les instruments d’acceptation des amendements qui impliquent de
nouvelles obligations doivent être déposés auprès du Directeur général de la
FAO, qui informera toutes les parties contractantes de la réception desdits
instruments et de l’entrée en vigueur desdits amendements.
6. Les propositions
d’amendement aux modèles de certificat phytosanitaire, joints en annexe à la
présente Convention, seront envoyées au Secrétaire et examinées et approuvées
par la Commission. Les amendements approuvés aux modèles de certificat
phytosanitaire figurant à l’annexe prendront effet dans un délai de
quatre-vingt-dix jours à compter de leur notification aux parties contractantes
par le Secrétaire.
7. Pendant une
période n’excédant pas douze mois à partir du moment où un amendement aux
modèles de certificat phytosanitaire figurant à l’annexe entre en vigueur, les
versions antérieures du certificat resteront, elles aussi, juridiquement
valables aux fins de la présente Convention.
Article XXII
Entrée en vigueur
La présente
Convention entrera en vigueur entre les parties lorsque trois États signataires
l’auront ratifiée. Elle entrera en vigueur pour tous les États ou organisations
qui sont membres de la FAO à la date du dépôt de leur instrument de ratification
ou d’adhésion.
Article XXIII
Dénonciation
1. Chacune des
parties contractantes peut à tout moment faire savoir qu’elle dénonce la
présente Convention par notification adressée au Directeur général de la FAO.
Le Directeur général de la FAO en informera immédiatement toutes les parties
contractantes.
2. La dénonciation
prendra effet un an après la date de réception de la notification par le
Directeur général de la FAO.

PRÄAMBEL
Die Vertragschließenden Parteien
in Erkenntnis der Notwendigkeit internationaler Zusammenarbeit bei der Bekämpfung von Schadorganismen der Pflanzen und Pflanzenerzeugnisse und der Verhinderung ihrer internationalen Ausbreitung sowie insbesondere ihrer Einschleppung in gefährdete Gebiete;
in Erkenntnis der Tatsache, dass phytosanitäre Maßnahmen fachlich gerechtfertigt, transparent sein und nicht derart angewendet werden sollten, dass sie eine willkürliche oder ungerechtfertigte Diskriminierung oder verdeckte Beschränkung, insbesondere des internationalen Handels, darstellen;
in dem Wunsch, eine enge Koordination der hierauf gerichteten Maßnahmen zu gewährleisten;
in dem Wunsch, einen Rahmen für die Entwicklung und die Anwendung von harmonisierten phytosanitären Maßnahmen und für die Ausarbeitung diesbezüglicher internationaler Standards festzulegen;
unter Berücksichtigung international anerkannter Grundsätze im Bereich des Pflanzenschutzes, des Schutzes der menschlichen und tierischen Gesundheit und des Umweltschutzes; und
in Anbetracht der Übereinkommen, die als Ergebnis der multilateralen Handels-Verhandlungen im Rahmen der Uruguay Runde beschlossen wurden, einschließlich dem Übereinkommen über die Anwendung sanitärer und phytosanitärer Maßnahmen;
haben folgendes vereinbart:
Artikel I
Zweck und Verpflichtungen
1. Um ein gemeinsames und wirkungsvolles Vorgehen gegen die Verbreitung und Einschleppung von Schadorganismen der Pflanzen und Pflanzenerzeugnisse zu gewährleisten und zur Förderung von geeigneten Bekämpfungsmaßnahmen gegen diese Schadorganismen, verpflichten sich die Vertragschließenden Parteien, die gesetzlichen, technischen und administrativen Maßnahmen zu ergreifen, die in diesem Übereinkommen und in den zusätzlichen Vereinbarungen gemäß Artikel XVI näher bezeichnet sind.
2. Unbeschadet der Verpflichtungen, die sich aus anderen internationalen Übereinkommen ergeben, verpflichtet sich jede Vertragschließende Partei, in ihrem Hoheitsgebiet dafür zu sorgen, dass die in diesem Übereinkommen vorgeschriebenen Anforderungen erfüllt werden.
3. Die Aufteilung der Verpflichtungen für die Erfüllung der Anforderungen dieses Übereinkommens zwischen Mitgliedsorganisationen der FAO und ihren Mitgliedstaaten, sofern sie Vertragschließende Parteien sind, erfolgt gemäß den jeweiligen Kompetenzen.
4. Dieses Übereinkommen kann erforderlichenfalls, wenn es die Vertragschließenden Parteien für zweckmäßig halten, zusätzlich zu Pflanzen und Pflanzenerzeugnissen auch auf Lagereinrichtungen, Verpackungsmaterial, Beförderungsmittel, Behälter, Erde bzw. Kultursubstrate und auf andere Lebewesen, Gegenstände oder Materialien, die Schadorganismen der Pflanzen beherbergen oder verbreiten können, Anwendung finden, insbesondere wenn es sich um internationale Transporte handelt.
Artikel II
Begriffsbestimmung
1. Für die Anwendung dieses Übereinkommens werden die nachstehenden Begriffe wie folgt definiert:
– „Ansiedlung“: Ein im Hinblick auf die
absehbare Zukunft andauerndes Vorkommen eines Schadorganismus in einem Gebiet,
nach dessen Eindringen;
– „Einschleppung“: Das Eindringen eines Schadorganismus mit dem Ergebnis seiner Ansiedlung;
– „Fachlich gerechtfertigt“: Gerechtfertigt auf Grund der Ergebnisse einer geeigneten Risikoanalyse für Schadorganismen oder gegebenenfalls einer anderen gleichwertigen Prüfung und Bewertung der verfügbaren wissenschaftlichen Informationen.
– „Gebiet mit geringem Auftreten von Schadorganismen“: Ein Gebiet – entweder ein Staat, ein Teil eines Staates, mehrere Staaten oder Teile mehrerer Staaten – das von den zuständigen Behörden festgelegt wurde und in dem ein bestimmter Schadorganismus nur in geringem Maße vorkommt und in dem hinsichtlich des Schadorganismus wirkungsvolle Überwachungs-, Bekämpfungs- oder Ausrottungsmaßnahmen getroffen werden;
– „Gefährdetes Gebiet“: Ein Gebiet, in dem die ökologischen Gegebenheiten die Ansiedlung eines Schadorganismus begünstigen und dessen Vorkommen in diesem Gebiet zu bedeutenden wirtschaftlichen Verlusten führen würde;
– „Geregelter Gegenstand“: Pflanzen, Pflanzenerzeugnisse, Lagerräume, Verpackungsmaterial, Transportmittel, Behälter, Erde bzw. Kultursubstrate und andere Lebewesen, Gegenstände oder Materialien, die Schadorganismen enthalten können oder durch die Schadorganismen verbreitet werden könnten, wenn hinsichtlich dieser Schadorganismen phytosanitäre Maßnahmen für nötig erachtet werden, insbesondere bei internationalen Transporten;
– „Geregelter Nicht-Quarantäne-Schadorganismus“: Ein Schadorganismus, der nicht als Quarantäneschadorganismus eingestuft ist und der im Fall seines Vorkommens bei Pflanzen, die zum Anpflanzen bestimmt sind, die vorgesehene Verwendung dieser Pflanzen in wirtschaftlich unannehmbaren Ausmaß beeinträchtigt und aus diesem Grund im Gebiet der einführenden Vertragschließenden Partei gesetzlich geregelt ist;
– „Geregelter Schadorganismus“: Ein Quarantäneschadorganismus oder ein geregelter Nicht-Quarantäne-Schadorganismus;
– „Harmonisierte phytosanitäre Maßnahmen“: Phytosanitäre Maßnahmen, die von den Vertragschließenden Parteien auf Grund von internationalen Standards festgelegt werden;
– „Internationale Standards“: Standards, die in Übereinstimmung mit Artikel X Abs. 1 und 2 festgelegt werden;
– „Kommission“: Die gemäß Artikel XI eingerichtete Kommission für phytosanitäre Maßnahmen;
– „Pflanzen“: Lebende Pflanzen und Pflanzenteile, einschließlich Samen und Keimplasma;
– „Pflanzenerzeugnisse“: Unverarbeitete Erzeugnisse pflanzlichen Ursprungs, einschließlich Getreide, sowie verarbeitete Erzeugnisse, die ihrer Natur nach oder auf Grund der Art ihrer Verarbeitung die Gefahr einer Einschleppung oder Ausbreitung von Schadorganismen hervorrufen können;
– „Phytosanitäre Maßnahmen“: Alle gesetzlichen Regelungen, Verwaltungsvorschriften oder amtlichen Verfahren mit dem Zweck, die Einschleppung und/oder die Ausbreitung von Schadorganismen zu verhindern;
– „Quarantäneschadorganismus“: Ein Schadorganismus von potentieller wirtschaftlicher Bedeutung für das durch den Schadorganismus gefährdete Gebiet, sofern der Schadorganismus in diesem Gebiet noch nicht vorkommt oder zwar bereits vorkommt, aber nicht weit verbreitet ist und gegen diesen Schadorganismus amtliche Bekämpfungsmaßnahmen ergriffen werden;
– „Regionale Standards“: Standards, die von einer regionalen Pflanzenschutzorganisation als Richtlinien für ihre Mitgliedstaaten festgelegt werden;
– „Risikoanalyse für Schadorganismen (Pest Risk Analysis – PRA)“: Der Prozeß zur Bewertung der biologischen oder sonstigen wissenschaftlichen sowie der wirtschaftlichen Fakten, um zu entscheiden, ob ein Schadorganismus geregelt werden sollte und in welchem Ausmaß phytosanitäre Maßnahmen gegen diesen Schadorganismus verhängt werden sollten;
– „Schadorganismus“: Alle Arten, Stämme oder Biotypen von Pflanzen, Tieren oder Krankheitserregern, die Pflanzen oder Pflanzenerzeugnisse schädigen;
– „Sekretär“: Der gemäß Artikel XII ernannte Sekretär der Kommission;
2. Die Begriffsbestimmungen gemäß diesem Artikel sind auf die Anwendung dieses Übereinkommens beschränkt und berühren nicht die in den nationalen gesetzlichen Vorschriften der Vertragschließenden Parteien enthaltenen Begriffsbestimmungen.
Artikel III
Anwendung von anderen internationalen Übereinkommen
Dieses Übereinkommen berührt in keiner Weise die bestehenden Rechte oder Verpflichtungen der Vertragschließenden Parteien auf Grund von anderen internationalen Übereinkommen.
Artikel IV
Allgemeine Regeln für die Organisation des Pflanzenschutzes in den einzelnen Staaten
1. Jede Vertragschließende Partei trifft nach besten Kräften Vorkehrungen für die Einrichtung einer nationalen amtlichen Pflanzenschutzorganisation mit den in diesem Artikel festgelegten Hauptaufgaben.
2. Zu den Aufgaben der nationalen amtlichen Pflanzenschutzorganisation gehören die folgenden Aufgaben:
a) Ausstellung von Zeugnissen für Sendungen von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen im Hinblick auf die phytosanitären Vorschriften der einführenden Vertragschließenden Partei;
b) Überwachung während des Wachstums von kultivierten Pflanzen (wie zB Feldern, Plantagen, Baumschulen, Gärten, Gewächshäusern und Laboratorien) und der Wildflora, sowie von Pflanzen und Pflanzenerzeugnissen, die gelagert sind oder sich am Transport befinden, insbesondere mit dem Ziel, das Vorkommen, das Auftreten und die Ausbreitung von Schadorganismen zu melden und diese Schadorganismen zu bekämpfen. Dies umfasst auch die Berichterstattung gemäß Artikel VIII Abs. 1 lit. a);
c) Untersuchung von Sendungen von Pflanzen und Pflanzenerzeugnissen im internationalen Verkehr und gegebenenfalls Untersuchung von anderen geregelten Gegenständen, insbesondere mit dem Ziel, die Einschleppung und/oder Ausbreitung von Schadorganismen zu verhindern;
d) Entwesung oder Entseuchung von Sendungen von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen im internationalen Verkehr, damit die phytosanitären Anforderungen erfüllt werden;
e) Schutz von gefährdeten Gebieten sowie Festlegung, Erhaltung und Überwachung von schadorganismusfreien Gebieten und von Gebieten mit geringem Auftreten von Schadorganismen;
f) Durchführung von Risikoanalysen für Schadorganismen;
g) Sicherstellung durch geeignete Verfahren, dass der phytosanitäre Zustand von Sendungen nach der Ausstellung von Pflanzengesundheitszeugnissen bis zur Ausfuhr im Hinblick auf die Zusammensetzung der Sendung, auf allfällige Veränderungen an der Sendung sowie hinsichtlich eines Neubefalles mit Schadorganismen beibehalten wird;
h) Schulung und Weiterbildung des Personals.
3. Jede Vertragschließende Partei trifft nach besten Kräften Vorkehrungen für
a) die Verteilung von Informationen in ihrem Hoheitsgebiet über geregelte Schadorganismen und über die diesbezüglichen Mittel zur Vorbeugung und Bekämpfung;
b) Forschung und Untersuchungen auf dem Gebiet des Pflanzenschutzes;
c) die Erlassung von phytosanitären Vorschriften; und
d) die Wahrnehmung sonstiger Aufgaben, die zur Umsetzung dieses Übereinkommens erforderlich sind.
4. Jede Vertragschließende Partei übermittelt dem Sekretär eine Beschreibung seiner nationalen amtlichen Pflanzenschutzorganisation und einen Bericht über Veränderungen in dieser Organisation. Jede Vertragschließende Partei stellt die Beschreibung der organisatorischen Vorkehrungen im Bereich des Pflanzenschutzes auf Anfrage auch einer anderen Vertragschließenden Partei zur Verfügung.
Artikel V
Ausstellung von Pflanzengesundheitszeugnissen
1. Jede Vertragschließende Partei trifft Vorkehrungen zur Ausstellung von Pflanzengesundheitszeugnissen. Dabei stellt sie sicher, dass Pflanzen, Pflanzenerzeugnisse und andere geregelte Gegenstände oder Sendungen mit diesem Inhalt beim Export der Erklärung im Pflanzengesundheitszeugnis, die in Übereinstimmung mit Absatz 2 lit. b) dieses Artikels abgegeben wird, entsprechen.
2. Jede Vertragschließende Partei trifft Vorkehrungen zur Ausstellung von Pflanzengesundheitszeugnissen in Übereinstimmung mit folgenden Vorschriften:
a) Untersuchungen und andere Tätigkeiten, die im Hinblick auf die Ausstellung von Pflanzengesundheitszeugnissen durchgeführt werden, werden nur durch die nationale amtliche Pflanzenschutzorganisation oder unter ihrer Aufsicht durchgeführt. Die Ausstellung von Pflanzengesundheitszeugnissen erfolgt nur durch fachlich qualifizierte Organe, die von der nationalen amtlichen Pflanzenschutzorganisation ordnungsgemäß beauftragt wurden und somit in ihrem Auftrag und unter ihrer Aufsicht handeln, mit solcher Kenntnis und auf Grund solcher Informationen, dass die Behörden der einführenden Vertragschließenden Parteien die Pflanzengesundheitszeugnisse als glaubwürdige Dokumente anerkennen können.
b) Pflanzengesundheitszeugnisse, auch wenn sie mit Hilfe der elektronischen Datenverarbeitung hergestellt wurden, sofern dies von der einführenden Vertragschließenden Partei akzeptiert wird, sind gemäß den in der Anlage zu diesem Übereinkommen wiedergegebenen Mustern abzufassen. Diese Zeugnisse sollten nach Maßgabe der entsprechenden internationalen Standards ausgestellt werden.
c) Nicht beglaubigte Änderungen oder Streichungen machen die Zeugnisse ungültig.
3. Jede Vertragschließende Partei verpflichtet sich, als Begleitpapiere für Sendungen von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen, die in ihr Hoheitsgebiet eingeführt werden, keine Pflanzengesundheitszeugnisse zu verlangen, die nicht den in der Anlage zu diesem Übereinkommen wiedergegebenen Mustern entsprechen. Jede Forderung nach zusätzlichen Erklärungen ist auf die Fälle, in denen dies fachlich gerechtfertigt ist, zu beschränken.
Artikel VI
Geregelte Schadorganismen
1. Die Vertragschließenden Parteien können hinsichtlich Quarantäneschadorganismen und geregelten Nicht-Quarantäne-Schadorganismen phytosanitäre Maßnahmen erlassen, vorausgesetzt, dass diese Maßnahmen
a) nicht strenger sind, als die Maßnahmen, die im Gebiet der einführenden Vertragschließenden Partei bezüglich des selben Schadorganismus angewandt werden, vorausgesetzt, dass dieser Schadorganismus im Gebiet der einführenden Vertragschließenden Partei vorkommt; und
b) auf ein solches Maß beschränkt bleiben, das für den Schutz der Pflanzengesundheit und/oder zur Sicherstellung der Eignung für den beabsichtigten Verwendungszweck erforderlich ist und durch die betroffene Vertragschließenden Partei fachlich gerechtfertigt werden kann.
2. Die Vertragschließenden Parteien setzen keine phytosanitären Maßnahmen hinsichtlich ungeregelter Schadorganismen.
Artikel VII
Einfuhrbestimmungen
1. Die Vertragschließenden Parteien sind uneingeschränkt befugt, in Übereinstimmung mit den in Frage kommenden internationalen Übereinkommen, Regelungen für die Einfuhr von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen zu erlassen, um die Einschleppung und/oder Ausbreitung von geregelten Schadorganismen in ihr Hoheitsgebiet zu verhindern. Sie können zu diesem Zweck
a) für die Einfuhr von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen phytosanitäre Maßnahmen, wie zB eine Untersuchung, ein Einfuhrverbot oder eine Behandlung vorschreiben bzw. verordnen;
b) für Pflanzen, Pflanzenerzeugnisse und andere geregelte Gegenstände oder für Sendungen mit diesem Inhalt, die den phytosanitären Maßnahmen gemäß lit. a) nicht entsprechen, die Einfuhr in das Gebiet der Vertragschließenden Partei verbieten, eine Quarantäne verhängen, eine Behandlung vorschreiben oder die Zerstörung oder Entfernung vom Gebiet der Vertragschließenden Partei anordnen;
c) die Verbringung von geregelten Schadorganismen in ihr Hoheitsgebiet verbieten oder beschränken;
d) die Verbringung von biologischen Bekämpfungsmitteln und von als nützlich geltenden Organismen, die für den Pflanzenschutz von Bedeutung sind, in ihr Hoheitsgebiet verbieten oder beschränken;
2. Um den internationalen Handel so wenig wie möglich zu behindern, verpflichtet sich jede Vertragschließende Partei, Veranlassungen gemäß Absatz 1 dieses Artikels unter Beachtung folgender Bestimmungen zu treffen:
a) Die Vertragschließenden Parteien treffen mit ihrer Pflanzenschutzgesetzgebung keine Maßnahmen gemäß Absatz 1 dieses Artikels, wenn diese nicht aus Erwägungen des Pflanzenschutzes notwendig und fachlich gerechtfertigt sind.
b) Wenn eine Vertragschließende Partei phytosanitäre Anforderungen, Beschränkungen und Verbote erlässt, veröffentlicht sie die entsprechenden Vorschriften umgehend und teilt sie allen unmittelbar betroffenen Vertragschließenden Parteien mit.
c) Wenn eine Vertragschließende Partei phytosanitäre Anforderungen, Beschränkungen und Verbote erlässt, unterrichtet sie auf Anfrage andere Vertragschließende Parteien über die Begründung für die Anforderungen, Beschränkungen und Verbote.
d) Wenn eine Vertragschließende Partei bestimmte Eintrittstellen für die Einfuhr bestimmter Pflanzen oder Pflanzenerzeugnisse vorschreibt, wählt sie diese Stellen so aus, dass der internationale Handel nicht unnötig behindert wird. Die Vertragschließende Partei veröffentlicht ein Verzeichnis dieser Grenzübergangstellen und übermittelt es dem Sekretär, jeder regionalen Pflanzenschutzorganisation, deren Mitglied sie ist, allen Vertragschließenden Parteien, die sie für unmittelbar betroffen hält, sowie auf Anfrage allen anderen Vertragschließenden Parteien. Derartige Einschränkungen auf bestimmte Eintrittstellen sind nur zulässig, wenn die betreffenden Pflanzen, Pflanzenerzeugnisse und anderen geregelten Gegenstände von Pflanzengesundheitszeugnissen begleitet sein müssen oder wenn sie einer Untersuchung oder Behandlung zu unterziehen sind.
e) Die seitens der Pflanzenschutzorganisation einer Vertragschließenden Partei vorgeschriebene Untersuchung oder ein anderes phytosanitäres Verfahren betreffend Sendungen von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen, die zur Einfuhr bestimmt sind, erfolgt innerhalb einer möglichst kurzen Frist und unter gebührender Berücksichtigung der Verderblichkeit der Pflanzen, Pflanzenerzeugnisse und anderen geregelten Gegenstände.
f) Wird festgestellt, dass bei der Einfuhr wesentliche phytosanitäre Anforderungen nicht erfüllt werden, informiert die einführende Vertragschließende Partei so rasch wie möglich die ausführende Vertragschließende Partei oder gegebenenfalls die wiederausführende Vertragschließende Partei davon. Die betroffene ausführende Vertragschließende Partei oder gegebenenfalls die wiederausführende Vertragschließende Partei stellt diesbezügliche Nachforschungen an und teilt auf Anfrage der einführenden Vertragschließenden Partei das Ergebnis dieser Nachforschung mit.
g) Die Vertragschließenden Parteien erlassen nur phytosanitären Maßnahmen, die fachlich gerechtfertigt sind, dem phytosanitären Risiko entsprechen, die geringstmögliche Einschränkung darstellen und den internationalen Personen- und Güterverkehr so wenig wie möglich behindern.
h) Die Vertragschließenden Parteien stellen sicher, dass phytosanitäre Maßnahmen umgehend abgeändert werden, wenn sich die Voraussetzungen für diese Maßnahmen geändert haben oder wenn neue Informationen vorliegen, oder dass die Maßnahmen ganz aufgehoben werden, wenn sie nicht mehr erforderlich sind.
i) Die Vertragschließenden Parteien erstellen nach besten Kräften Listen der geregelten Schadorganismen, wobei sie deren wissenschaftliche Bezeichnungen verwenden. Sie halten diese Listen auf dem aktuellen Stand und übermitteln sie dem Sekretär, den regionalen Pflanzenschutzorganisationen, denen sie angehören und auf Anfrage anderen Vertragschließenden Parteien.
j) Die Vertragschließenden Parteien führen nach besten Kräften Überwachungsmaßnahmen hinsichtlich der Schadorganismen durch und führen geeignete Aufzeichnungen über den Status der Schadorganismen, um deren Einordnung in Kategorien zu ermöglichen und um geeignete phytosanitäre Maßnahmen auszuarbeiten. Diese Aufzeichnungen werden auf Antrag anderen Vertragschließenden Parteien zugänglich gemacht.
3. Eine Vertragschließende Partei kann Maßnahmen gemäß diesem Artikel auch auf solche Schadorganismen anwenden, die sich in seinem Gebiet nicht ansiedeln können, die jedoch wirtschaftliche Schäden hervorrufen können, wenn sie eingeschleppt werden. Auch solche Maßnahmen müssen fachlich gerechtfertigt sein.
4. Maßnahmen gemäß diesem Artikel dürfen von den Vertragschließenden Parteien nur dann auf Transitsendungen durch ihr Hoheitsgebiet angewendet werden, wenn diese Maßnahmen fachlich gerechtfertigt und zum Schutz gegen die Einschleppung und/oder Ausbreitung von Schadorganismen erforderlich sind.
5. Dieser Artikel hindert die einführenden Vertragschließenden Parteien nicht daran, unter Einhaltung der erforderlichen Vorsichtsmaßnahmen, spezielle Vorschriften für die Einfuhr von Pflanzen, Pflanzenerzeugnissen und anderen geregelten Gegenständen sowie für Schadorganismen von Pflanzen für wissenschaftliche oder für Schulungszwecke oder für andere Spezialfälle zu erlassen.
6. Dieser Artikel hindert die Vertragschließenden Parteien nicht daran, bei Feststellung eines Schadorganismus oder auf Grund einer Mitteilung über das Auftreten eines Schadorganismus, der für ihr Hoheitsgebiet eine potentielle Gefährdung darstellt, geeignete Notmaßnahmen anzuwenden. Solche Maßnahmen sind so rasch wie möglich zu überprüfen, um festzustellen, ob ihre Aufrechterhaltung gerechtfertigt ist. Notmaßnahmen sind den betroffenen Vertragschließenden Parteien, dem Sekretär und jeder regionalen Pflanzenschutzorganisation, der die Vertragschließende Partei angehört, umgehend mitzuteilen.
Artikel VIII
Internationale Zusammenarbeit
1. Die Vertragschließenden Parteien arbeiten soweit wie möglich bei der Verwirklichung der Ziele dieses Übereinkommens zusammen, wobei sie insbesondere folgende Punkte beachten:
a) Zusammenarbeit beim Austausch von Informationen über Schadorganismen von Pflanzen, insbesondere bei der Meldung über das Vorkommen, das Auftreten und die Ausbreitung von Schadorganismen, die eine unmittelbare oder mögliche Gefahr darstellen. Die Kommission kann für diesen Informationsaustausch ein Verfahren festlegen;
b) Teilnahme, soweit dies möglich ist, an speziellen Bekämpfungskampagnen gegen Schadorganismen, die für die Pflanzenproduktion eine ernste Gefahr darstellen, wenn zur Bekämpfung Notmaßnahmen auf internationaler Ebene erforderlich sind;
c) Zusammenarbeit, soweit dies möglich ist, bei der Bereitstellung von wissenschaftlichen Informationen, die für Risikoanalysen für Schadorganismen benötigt werden.
2. Jede Vertragschließende Partei benennt eine Kontaktstelle, die für den Informationsaustausch im Zusammenhang mit der Umsetzung dieses Übereinkommens zuständig ist.
Artikel IX
Regionale Pflanzenschutzorganisationen
1. Die Vertragschließenden Parteien verpflichten sich zur Zusammenarbeit bei der Errichtung regionaler Pflanzenschutzorganisationen in geeigneten Gebieten.
2. Die regionalen Pflanzenschutzorganisationen nehmen in den ihnen unterstehenden Gebieten Koordinierungsaufgaben wahr. Sie beteiligen sich an verschiedenen Maßnahmen zur Verwirklichung der Ziele dieses Übereinkommens und sie sammeln und verteilen erforderlichenfalls Informationen.
3. Die regionalen Pflanzenschutzorganisationen arbeiten mit dem Sekretär zusammen, um die Ziele dieses Übereinkommens zu verwirklichen und sie arbeiten gegebenenfalls mit dem Sekretär und der Kommission bei der Ausarbeitung von internationalen Standards zusammen.
4. Der Sekretär beruft regelmäßig technische Konsultationen von Vertretern der regionalen Pflanzenschutzorganisationen ein, um
a) die Ausarbeitung und die Anwendung von internationalen Standards für phytosanitäre Maßnahmen zu unterstützen; und
b) die interregionale Zusammenarbeit durch die Förderung von harmonisierten phytosanitären Maßnahmen zur Bekämpfung von Schadorganismen und zur Verhinderung deren Einschleppung und/oder Ausbreitung zu unterstützen.
Artikel X
Standards
1. Die Vertragschließenden Parteien vereinbaren die Zusammenarbeit bei der Ausarbeitung von internationalen Standards gemäß den von der Kommission beschlossenen Verfahren.
2. Internationale Standards werden von der Kommission beschlossen.
3. Regionale Standards sollten mit den Grundsätzen dieses Übereinkommens übereinstimmen. Derartige Standards können der Kommission als Grundlage für die Ausarbeitung von internationalen Standards für phytosanitäre Maßnahmen vorgelegt werden, wenn sie auch überregionale Bedeutung haben.
4. Wenn die Vertragschließenden Parteien Tätigkeiten in Zusammenhang mit diesem Übereinkommen durchführen, sollten sie gegebenenfalls die bezughabenden internationalen Standards berücksichtigen.
Artikel XI
Kommission für phytosanitäre Maßnahmen
1. Die Vertragschließenden Parteien vereinbaren, im Rahmen der Ernährungs- und Landwirtschaftsorganisation der Vereinten Nationen (FAO) eine Kommission für Phytosanitäre Maßnahmen (Commission on Phytosanitary Measures – CPM) einzusetzen.
2. Die Aufgaben der Kommission bestehen darin, die vollständige Verwirklichung der Ziele dieses Übereinkommens zu unterstützen, insbesondere im Hinblick auf folgende Punkte:
a) Sie überprüft die weltweite Situation auf dem Gebiet des Pflanzenschutzes und prüft, inwieweit Handlungsbedarf bei der Bekämpfung der internationalen Ausbreitung von Schadorganismen und deren Einschleppung in gefährdete Gebiete besteht;
b) Sie erarbeitet und überwacht die notwendigen institutionellen Voraussetzungen und Verfahren für die Entwicklung und Annahme von internationalen Standards und sie beschließt internationale Standards;
c) Sie legt Regeln und Verfahren für die Streitschlichtung gemäß Artikel XIII fest;
d) Sie setzt Unterausschüsse der Kommission ein, soweit dies für die ordnungsgemäße Erfüllung der Aufgaben der Kommission erforderlich ist;
e) Sie beschließt Richtlinien für die Anerkennung von regionalen Pflanzenschutzorganisationen;
f) Sie gewährleistet die Zusammenarbeit mit anderen internationalen Organisationen in Angelegenheiten, auf die sich dieses Übereinkommen erstreckt;
g) Sie beschließt Empfehlungen für die Umsetzungen dieses Übereinkommens, soweit dies erforderlich ist;
h) Sie nimmt sonstige Aufgaben wahr, soweit dies zur Verwirklichung der Ziele dieses Übereinkommens erforderlich ist.
3. Die Mitgliedschaft in der Kommission steht allen Vertragschließenden Parteien offen.
4. Die Vertragschließenden Parteien werden in Tagungen der Kommission durch einen Delegierten vertreten. Dieser kann von einem Stellvertreter sowie von Sachverständigen oder Beratern begleitet werden. Stellvertreter, Sachverständige oder Berater sind berechtigt, an den Veranstaltungen der Kommission teilzunehmen, sie haben jedoch kein Stimmrecht, es sei denn, ein Stellvertreter wird ordnungsgemäß bevollmächtigt, den Delegierten zu vertreten.
5. Die Vertragschließenden Parteien unternehmen alle Anstrengungen, um alle Beschlüsse durch Konsens zu erreichen. Wenn alle Bemühungen, Konsens zu erreichen, vergeblich waren, und auf diese Weise kein Beschluß gefaßt werden kann, werden Beschlüsse durch Zwei-Drittel-Mehrheit der anwesenden und abstimmenden Vertragschließenden Parteien gefaßt.
6. Wenn eine Mitgliedsorganisation der FAO und ihre Mitglieder Vertragschließende Parteien sind, dann gelten für ihre Mitgliedschaft in der Kommission und die Rechte und Verpflichtungen, die sich daraus ergeben, sinngemäß die Verfassung und allgemeinen Regeln der FAO.
7. Die Kommission gibt sich eine eigene Geschäftsordnung, die mit diesem Übereinkommen und der Verfassung der FAO im Einklang steht, und kann diese erforderlichenfalls auch ändern.
8. Einmal jährlich beruft der Vorsitzende der Kommission eine ordentliche Tagung der Kommission ein.
9. Außerordentliche Tagungen der Kommission werden durch den Vorsitzenden der Kommission auf Antrag von mindestens einem Drittel der Kommissionsmitglieder einberufen.
10. Die Kommission wählt ihren Vorsitzenden und höchstens zwei stellvertretende Vorsitzende, deren Amtszeit jeweils zwei Jahre beträgt.
Artikel XII
Sekretariat
1. Der Sekretär der Kommission wird vom Generaldirektor der FAO ernannt.
2. Der Sekretär wird durch Sekretariatspersonal im erforderlichen Ausmaß unterstützt.
3. Der Sekretär ist für die Umsetzung der Politik und der Aktivitäten der Kommission verantwortlich. Er führt auch andere Aufgaben aus, die ihm durch dieses Übereinkommen auferlegt werden und erstattet der Kommission darüber Bericht.
4. Der Sekretär verteilt:
a) Internationale Standards innerhalb von sechzig Tagen nach ihrer Annahme an alle Vertragschließenden Parteien;
b) Listen der Eintrittstellen, die von Vertragschließenden Parteien gemäß Artikel VII Abs. 2 lit. d) übermittelt werden, an alle Vertragschließenden Parteien;
c) Listen der geregelten Schadorganismen, deren Einfuhr verboten ist oder die unter die Bestimmungen von Artikel VII Abs. 2 lit. i) fallen, an alle Vertragschließenden Parteien und an regionale Pflanzenschutzorganisationen;
d) Informationen von Vertragschließenden Parteien über phytosanitäre Anforderungen, Beschränkungen und Verbote gemäß Artikel VII Abs. 2 lit. b) sowie Beschreibungen von nationalen amtlichen Pflanzenschutzorganisationen gemäß Artikel IV Abs. 4.
5. Der Sekretär sorgt für die Übersetzung der Unterlagen für Tagungen der Kommission und der internationalen Standards in die Amtssprachen der FAO.
6. Der Sekretär arbeitet mit den regionalen Pflanzenschutzorganisationen bei der Verwirklichung der Ziele dieses Übereinkommens zusammen.
Artikel XIII
Streitschlichtung
1. Ergeben sich Streitigkeiten über die Auslegung oder Anwendung dieses Übereinkommens oder ist eine Vertragschließende Partei der Auffassung, dass eine von einer anderen Partei getroffene Maßnahme mit den Verpflichtungen, die der anderen Partei gemäß den Artikeln V und VII dieses Übereinkommens obliegen, unvereinbar ist, insbesondere hinsichtlich der Gründe für die Verhängung eines Einfuhrverbotes oder einer Einfuhrbeschränkung für Pflanzen, Pflanzenerzeugnisse und andere geregelte Gegenstände mit Herkunft aus dem Hoheitsgebiet der ersten Vertragschließenden Partei, dann nehmen die betroffenen Vertragschließenden Parteien so bald wie möglich miteinander Beratungen auf, um die Streitigkeiten beizulegen.
2. Ist es nicht möglich, die Streitigkeiten durch Beratungen gemäß Absatz 1 beizulegen, kann die betroffene Vertragschließende Partei bzw. können die betroffenen Vertragschließenden Parteien beim Generaldirektor der FAO die Einsetzung eines Sachverständigenausschusses zur Prüfung der Streitfrage gemäß den Regeln und Verfahren, die diesbezüglich von der Kommission erlassen werden können, beantragen.
3. Diesem Ausschuss gehören auch Vertreter aller beteiligten Vertragschließenden Parteien an. Der Ausschuss prüft die Streitfrage unter Berücksichtigung aller von den beteiligten Vertragschließenden Parteien vorgelegten sachdienlichen Unterlagen und Beweismittel. Der Ausschuss verfasst über die fachlichen Aspekte der Streitigkeiten einen Bericht mit dem Ziel, eine Streitschlichtung herbeizuführen. Die Erstellung und Annahme des Berichtes erfolgt gemäß den Regeln und Verfahren, die diesbezüglich von der Kommission festgelegt werden. Der Generaldirektor der FAO übermittelt den Bericht den beteiligten Vertragschließenden Parteien. Der Bericht kann auf deren Antrag auch der für Streitschlichtung im Handel verantwortlichen internationalen Organisation übermittelt werden.
4. Die Vertragschließenden Parteien stimmen darin überein, dass die Empfehlungen dieses Ausschusses, obzwar von nicht verbindlichem Charakter, die Grundlage für eine Neubeurteilung der Angelegenheit, aus der sich die Streitigkeiten ergeben haben, bilden werden.
5. Die beteiligten Vertragschließenden Parteien teilen sich die Kosten, die sich auf Grund der Tätigkeit der Sachverständigen ergeben.
6. Die Bestimmungen dieses Artikels gelten ergänzend zu den Streitschlichtungsbestimmungen, die auf Grund von anderen internationalen Übereinkommen betreffend Handelsangelegenheiten bestehen und stehen nicht in Widerspruch zu diesen.
Artikel XIV
Ersetzung früherer Übereinkommen
Dieses Übereinkommen setzt in den Beziehungen zwischen den Vertragschließenden Parteien die Internationale Konvention betreffend Maßnahmen gegen Phyloxera vastatrix vom 3. November 1881, das Berner Zusatzabkommen vom 15. April 1889 und das Internationale Pflanzenschutzabkommen von Rom vom 16. April 1929 außer Kraft und tritt an ihre Stelle.
Artikel XV
Territorialer Geltungsbereich
1. Jede Vertragschließende Partei kann zum Zeitpunkt der Ratifikation oder des Beitrittes oder jederzeit danach dem Generaldirektor der FAO eine Erklärung übermitteln, dass dieses Übereinkommen auf das gesamte Hoheitsgebiet oder einzelne Teile davon, deren internationale Beziehungen sie wahrnimmt, Anwendung findet. Dieses Übereinkommen tritt mit dem dreißigsten Tag nach Eingang der Erklärung beim Generaldirektor für alle darin bezeichneten Hoheitsgebiete in Kraft.
2. Jede Vertragschließende Partei, die dem Generaldirektor der FAO eine Erklärung nach Absatz 1 dieses Artikels übermittelt hat, kann jederzeit eine neue Erklärung übermitteln, durch die der Geltungsbereich einer früheren Erklärung geändert oder die Anwendung des Übereinkommens auf ein bestimmtes Hoheitsgebiet beendet wird. Die Änderung oder die Beendigung der Anwendung wird mit dem dreißigsten Tag nach Eingang der Erklärung beim Generaldirektor wirksam.
3. Der Generaldirektor der FAO unterrichtet alle Vertragschließenden Parteien von den gemäß diesem Artikel eingegangenen Erklärungen.
Artikel XVI
Zusätzliche Übereinkommen
1. Die Vertragschließenden Parteien können zusätzliche Übereinkommen schließen, um spezielle Pflanzenschutzprobleme, die besondere Aufmerksamkeit oder besondere Maßnahmen erfordern, zu behandeln. Derartige Übereinkommen können sich auf spezielle Regionen, Schadorganismen, Pflanzen oder Pflanzenerzeugnisse oder auf bestimmte Methoden des internationalen Handels mit Pflanzen und Pflanzenerzeugnissen beziehen oder die Bestimmungen dieses Übereinkommens in anderer Weise ergänzen.
2. Jedes derartige zusätzliche Übereinkommen tritt für alle betroffenen Vertragschließenden Parteien nach der Annahme gemäß den Vorschriften der betreffenden zusätzlichen Übereinkommen in Kraft.
3. Zusätzliche Übereinkommen dienen der Unterstützung der Ziele dieses Übereinkommens und müssen mit den Grundsätzen dieses Übereinkommens und mit seinen Bestimmungen übereinstimmen. Darüber hinaus müssen sie auch den Grundsätzen der Transparenz, der Nicht-Diskriminierung und der Vermeidung von verdeckten Beschränkungen, insbesondere im internationalen Handel, entsprechen.
Artikel XVII
Ratifikation und Beitritt
1. Dieses Übereinkommen liegt für alle Staaten bis zum 1. Mai 1952 zur Unterzeichnung auf. Es ist so bald wie möglich zu ratifizieren. Die Ratifikationsurkunden werden beim Generaldirektor der FAO hinterlegt. Dieser benachrichtigt alle Unterzeichnerstaaten vom Zeitpunkt der Hinterlegung.
2. Die Staaten, welche dieses Übereinkommen nicht unterzeichnet haben, können ihm nach seinem In-Kraft-Treten gemäß Artikel XXII beitreten. Der Beitritt erfolgt durch Hinterlegung der Beitrittsurkunde beim Generaldirektor der FAO. Dieser benachrichtigt davon alle Vertragschließenden Parteien.
3. Wird eine Mitgliedsorganisation der FAO Vertragspartei dieses Übereinkommens, dann informiert sie gegebenenfalls zum Zeitpunkt ihres Beitrittes gemäß den Bestimmungen von Artikel II Abs. 7 der Verfassung der FAO über alle Änderungen oder Klarstellungen, die sich im Zusammenhang mit ihrer gemäß Artikel II Abs. 5 der Verfassung der FAO abgegebenen „Erklärung der Kompetenzverteilung“ ergeben, soweit dies im Zusammenhang mit der Annahme dieses Übereinkommens erforderlich ist. Jede Vertragschließende Partei kann jederzeit eine Mitgliedsorganisation der FAO, die Vertragschließende Partei dieses Übereinkommens ist, um Auskunft darüber ersuchen, ob die Mitgliedsorganisation oder ihre Mitglieder für die Durchführung von Maßnahmen in einem bestimmten Bereich, der von diesem Übereinkommen erfaßt ist, verantwortlich sind. Diese Informationen werden von der Mitgliedsorganisation innerhalb eines angemessenen Zeitraums vorgelegt.
Artikel XVIII
Nicht-Vertragsparteien
Die Vertragschließenden Parteien ermutigen Staaten oder Mitgliedsorganisationen der FAO, die keine Vertragschließenden Parteien dieses Übereinkommens sind, dieses Übereinkommen anzunehmen und sie ermutigen jede Nicht-Vertragspartei, phytosanitäre Maßnahmen, die im Einklang mit diesem Übereinkommen stehen und internationale Standards, die gemäß diesem Übereinkommen beschlossen wurden, anzuwenden.
Artikel XIX
Sprachen
1. Dieses Übereinkommen ist in allen Amtssprachen der FAO authentisch.
2. Die Vertragschließenden Parteien sind auf Grund dieses Übereinkommens, mit Ausnahme der in Absatz 3 genannten Fälle, nicht verpflichtet, Dokumente oder Kopien davon in einer anderen Sprache als der Amtssprache (den Amtssprachen) der Vertragschließenden Partei zur Verfügung zu stellen oder zu veröffentlichen.
3. Die folgenden Dokumente werden zumindest in einer der Amtssprachen der FAO abgefaßt:
a) Informationen, die gemäß Artikel IV Abs. 4 vorgelegt werden;
b) Vermerke hinsichtlich der bibliographischen Daten von Dokumenten, die gemäß Artikel VII Abs. 2 lit. b) übermittelt werden;
c) Informationen, die gemäß Artikel VII Abs. 2 lit. b), d), i) und j) vorgelegt werden;
d) Vermerke hinsichtlich der bibliographischen Daten und eine kurze Zusammenfassung sachdienlicher Dokumente betreffend Informationen, die gemäß Artikel VIII Abs. 1 lit. a) vorgelegt werden;
e) Anfragen, die an Kontaktstellen gerichtet werden und Antworten auf derartige Anfragen, nicht aber Dokumente, die in der Anlage zu solchen Antworten übermittelt werden;
f) alle Dokumente, die von einer Vertragschließenden Partei für Tagungen der Kommission vorgelegt werden.
Artikel XX
Technische Unterstützung
Um die Umsetzung dieses Übereinkommens zu erleichtern, kommen die Vertragschließenden Parteien überein, die Bereitstellung technischer Unterstützung der Vertragschließenden Parteien, insbesondere wenn es sich um Entwicklungsländer handelt, zu fördern, und zwar entweder auf bilateralem Wege oder über geeignete internationale Organisationen.
Artikel XXI
Abänderungen
1. Jeder Vorschlag einer Vertragschließenden Partei für die Änderung dieses Übereinkommens ist dem Generaldirektor der FAO zu übermitteln.
2. Jeder Änderungsvorschlag, den eine Vertragschließende Partei beim Generaldirektor der FAO einbringt, wird einer ordentlichen oder außerordentlichen Tagung der Kommission zur Genehmigung vorgelegt. Werden mit einem Antrag wichtige Änderungen technischer Art vorgeschlagen oder den Vertragschließenden Parteien dadurch zusätzliche Verpflichtungen auferlegt, so wird der Vorschlag von einem beratenden Sachverständigenausschuß geprüft, der von der FAO vor der Behandlung durch die Kommission einberufen wird.
3. Jeder Vorschlag zur Änderung des Übereinkommens, abgesehen von Änderungen des Anhangs, wird den Vertragschließenden Parteien spätestens mit der Übersendung der Tagesordnung für die Tagung der Kommission, bei der dieser Vorschlag geprüft werden soll, durch den Generaldirektor der FAO bekanntgegeben.
4. Jeder derartige Änderungsvorschlag bedarf der Genehmigung durch die Kommission. Die Änderung tritt mit dem dreißigsten Tag nach ihrer Annahme durch zwei Drittel der Vertragschließenden Parteien in Kraft. Wenn eine Mitgliedsorganisation der FAO eine Annahmeerklärung im Sinne dieses Artikels abgibt, zählt diese nicht zusätzlich zu den Erklärungen der Mitglieder der Organisation.
5. Änderungen, die den Vertragschließenden Parteien neue Verpflichtungen auferlegen, treten für jede Vertragschließende Partei erst in Kraft, nachdem sie von ihr angenommen worden sind, und zwar mit dem dreißigsten Tag nach dieser Annahme. Urkunden über die Annahme von Änderungen, die neue Verpflichtungen mit sich bringen, werden beim Generaldirektor der FAO hinterlegt. Dieser setzt alle Vertragschließenden Parteien vom Eingang der Annahmeurkunden und vom In-Kraft-Treten der Änderungen in Kenntnis.
6. Vorschläge für die Änderung der Muster für Pflanzengesundheitszeugnisse, die im Anhang dieses Übereinkommens festgelegt werden, sind dem Sekretär zu übermitteln und werden der Kommission zur Genehmigung vorgelegt. Derartige Änderungen treten neunzig Tage nach ihrer Bekanntgabe durch den Sekretär an die Vertragschließenden Parteien in Kraft.
7. Die vorhergehende Version des Pflanzengesundheitszeugnisses bleibt für Zwecke dieses Übereinkommens für einen Zeitraum von höchstens zwölf Monaten, gerechnet ab der Änderung des Musters, weiterhin gültig.
Artikel XXII
In-Kraft-Treten
Sobald dieses Übereinkommen von drei Unterzeichnerstaaten ratifiziert worden ist, tritt es zwischen ihnen in Kraft. Für die anderen Staaten oder Mitgliedsorganisationen tritt es mit Hinterlegung ihrer Ratifikations- oder Beitrittsurkunde in Kraft.
Artikel XXIII
Kündigung
1. Jede Vertragschließende Partei kann dieses Übereinkommen durch eine an den Generaldirektor der FAO gerichtete Notifikation jederzeit kündigen. Der Generaldirektor setzt alle Vertragschließenden Parteien hievon sofort in Kenntnis.
2. Die Kündigung wird ein Jahr nach Eingang der Notifikation beim Generaldirektor der FAO wirksam.
